Purpose of Item: An Ordinance amending Chapter 55 of the City Code to enhance the alternative alley closure and vacation procedure by relaxing certain restrictions to allow additional unimproved alleys to qualify for closure and vacation using the alternative procedure. Background Information: On December 19, 2003, Chapter 55 of the City Code was amended to provide a simplified method for the closure and vacation of public and private alleys located within single family and duplex residential neighborhoods. That procedure currently requires that the alley to be closed and vacated be located entirely within the single family and duplex zoning district. This restriction has disqualified certain alleys that are located between single family/duplex'zoning districts and more intense zoning districts. In the case of unimproved alleys (alleys which have never been improved and remain in their natural state) that have been disqualified and do not provide service access to the more intense zoning side of the alley, the current zoning district restriction is inconsistent with the pattern of alley vacation and closures throughout the remainder of the residential neighborhood and unfair to those single family/duplex residents abutting the opposite side of the alley. The proposed Ordinance will relax the zoning district restriction to allow those unimproved alleys abutting on one side of a more intense zoning district to qualify for closure and vacation utilizing the alternative procedure.
