HomeMy WebLinkAboutPZAB LegislationCity of Miami Legislation PZAB Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01243 Final Action Date: A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD RECOMMENDING APPROVAL OR DENIAL OF A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING WITH CONDITIONS A DEVELOPMENT FOR THE MIAMI-DADE COUNTY GENERAL SERVICES ADMINISTRATION WEST LOT MULTI -USE FACILITY, TO BE LOCATED AT APPROXIMATELY 220 NORTHWEST 3RD STREET, MIAMI, FLORIDA, WITHIN THE PREVIOUSLY -APPROVED DOWNTOWN GOVERNMENT CENTER, DEVELOPMENT OF REGIONAL IMPACT, UNDER ZONING ORDINANCE NO. 6871, AS AMENDED; AND DIRECTING TRANSMITTALS TO AFFECTED AGENCIES. LOCATION: Approximately 220 NW 3rd Street [Commissioner Richard P. Dunn II - District 5] APPLICANT(S): George M. Burgess, County Manager, on behalf of Miami -Dade County FINDING(S): PLANNING DEPARTMENT: Recommended approval with conditions*. *See supporting documentation. PURPOSE: This is the final project of the Downtown Government Center DRI to provide 266,016 square feet of parking; 9,088 square feet of retail space; and 44,346 square feet of Office space. WHEREAS, on April 23, 1981, the City of Miami approved a Development Order submitted by Miami -Dade County for the Downtown Government Center; and WHEREAS, said Development Order expired in 1987; and WHEREAS, Miami -Dade County has identified new projects for the Downtown Government Center, including but not limited to, the Miami -Dade County General Services Administration ("GSA") West Lot Mufti -Use Facility; and WHEREAS, pursuant to Chapter 163, Part II, Florida Statutes, the Miami Comprehensive Neighborhood Plan ("MCNP") was adopted on February 9, 1989, pursuant to Ordinance No. 10544, and amended by the Miami City Commission through March 23, 2006; and WHEREAS, Miami -Dade County ("APPLICANT") previously submitted an application for a Notice of Proposed Change ("NOPC") to the Downtown Government Center Development of Regional Impact ("DRI") to the South Florida Regional Planning Council, the Florida Department of Community City of Miami Page 1 of 2 File Id: 10-01243 (Version: 1) Printed On: 11/9/2010 File Number: 10-01243 Affairs, and the City of Miami, pursuant to Florida Statutes 380.06 (2004); and WHEREAS, the Miami Planning Advisory Board, at its meeting held on June 15, 2005, following an advertised public hearing, adopted Resolution No. PAB 61-05 by a vote of six to zero (6-0), RECOMMENDING APPROVAL of the NOPC to the Downtown Government Center DRI; and WHEREAS, on September 22, 2005, the City Commission conducted a public hearing pursuant to F.S. 380.06 (2004); and WHEREAS, the City Commission considered the Application for Development Approval, the report and recommendations of the South Florida Regional Planning Council and the Miami Planning Advisory Board, and each element required to be considered by Florida Statute 380.06 (2004); and WHEREAS, the reactivated DRI required that the Miami Dade County GSA West Lot Multi -Use Facility project obtain an approval of the City Commission; and WHEREAS, the Miami -Dade County GSA West Lot Multi -Use Facility project has met the project review requirements by submitting for review and incorporating comments from the Urban Development Review Board on September 15, 2010, and Internal Design Review Committee on October 13, 2010; and WHEREAS, the Miami Planning, Zoning and Appeals Board, at its meeting on November 17, 2010, following an advertised public hearing, adopted Resolution No. PZAB-R-* by a vote of * to * (* *), item no. *, recommending * to the Miami City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. This Resolution approves with conditions the development of the Miami -Dade County General Services Administration West Lot Multi -Use facility within the previously -approved Downtown Government Center Development of Regional Impact. Section 3. The City Manager is directed to instruct the Planning Director to transmit a copy of this Resolution and attachment to the Applicant. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
