HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01293 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT FOR WATER AND SANITARY SEWAGE SERVICES BETWEEN THE MIAMI-DADE COUNTY WATER AND SEWER DEPARTMENT, THE CITY OF MIAMI, THE MUSEUM OF SCIENCE, INC., AND THE MIAMI ART MUSEUM OF DADE COUNTY ASSOCIATION, INC., IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE MUSEUM PARK PROJECT, B-30538; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A COVENANT RUNNING WITH THE LAND IN LIEU OF UNITY OF TITLE FOR THE PROJECT. WHEREAS, the City of Miami ("City"), Museum of Science, Inc. ("Science Museum"), and Miami. Art Museum of Dade County Association, Inc. ("Art Museum"), identified as the Developer, intend to redevelop the existing Bicentennial Park located in Downtown Miami; and WHEREAS, the City intends to construct a new City park facility with restrooms, office space, and a mooring facility representing a total average daily use of water of 5,619 gallons; and WHEREAS, no increase in the total average daily water and sewer usage for the City park facility will occur as a result of the redevelopment, therefore, no water and sewer connection charges will be assessed to the City; and WHEREAS, the Science Museum and Art Museum will be responsible for the daily average water and sewer use associated with the new construction of their respective museum facilities as further detailed in previous lease agreements; and WHEREAS, a Covenant Running with the Land in lieu of Unity of Title for the property is required; and WHEREAS, this covenant allows the City to operate and maintain a private water system, a private sanitary sewer system and associated other facilities, including water mains and lines and gravity sewer lines, from which the property shall be connected to the water and sanitary sewer system owned and operated by Miami -Dade County; and WHEREAS, the City agrees tc restrict the use of the property as described in the attached covenant; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fi iy set forth in this Section. The City Manager is authorized{1 } to execute an Agreement for water and sewage services between the Miami -Dade County Water and Sewer Department, the City, the Science Museum, and the Art Museum, in substantially the attached form, for the Museum Park Project, B- 30538. Section 3. The City Manager is further authorized{1} to execute a Covenant Running with the Land in lieu of Unity of Title for said project. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS:& JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
