HomeMy WebLinkAboutMiami Certification and Declaration ofResults-November 2, 2010 ElectionsCERTIFICATION AND DECLARATION OF RESULTS ON THE CITY OF MIAMI MUNICIPAL ELECTION AND REFERENDUM SPECIAL ELECTION HELD ON TUESDAY, NOVEMBER 2, 2010 STATE OF FLORIDA COUNTY OF MIAMI-DADE ) CITY OF MIAMI ) I, Priscilla A. Thompson, City Clerk of the City of Miami, Florida, and as the Canvassing Board for the City of Miami (hereinafter referred to as "Canvassing Board") do hereby certify that all necessary legal steps were taken in connection with the conduct of a City of Miami Municipal Election and Referendum Special Election held on Tuesday, November 2, 2010, including, though not limited to, the following Logic and Accuracy Tests: I. On Wednesday, October 13, 2010 (testing of equipment used on election day): A. Commencing at approximately 10:00 a.m., the Miami -Dade County Supervisor of Elections representative had the tabulating equipment tested to ascertain that the equipment would correctly count the precinct and absentee ballots cast for the candidates and/or issues, to be voted in the Miami Municipal Election and Referendum Special Election held on November 2, 2010. B. A Miami -Dade County Canvassing Board representative compared the test results with the predetermined totals for each candidate and/or issue and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the programs and equipment, as well as any replacement of said materials required by said tests, subject to said tests. C. At the completion of the above test, the verified Logic and Accuracy reports and test materials were placed in a sealed container with Seal Number 434, and steps have been taken to ensure the security of said materials prior to, during and subsequent to the election, except when said materials were properly in the possession of the Elections Department staff appointed to conduct the election. II. On Wednesday, October 27, 2010 through Monday, November 1, 2010 (testing of equipment used on election day and canvass of absentee ballots presumed invalid): A. On Wednesday, October 27, 2010, the Miami -Dade County Supervisor of Elections set the time to begin the opening of the valid absentee ballots and the duplication of ballots (as needed) at 11:00 a.m. and commencing at 1 p.m. 1 on Monday, November 1, 2010, the Canvassing Board resumed opening of the absentee ballots. III.On Tuesday, November 2, 2010 (Election Day) A. At approximately 4:00 p.m., the Miami -Dade County Supervisor of Elections began the pre -count logic and accuracy test of the optical scan system used for paper ballots, located at the Elections Department at 2700 NW 87 Avenue, to ascertain that the equipment had not been tampered with, and that it would correctly count the precinct and absentee ballot votes cast for all City of Miami candidates and referendum question. B. At the completion of the precinct and absentee ballot count, the pre -election test of the automatic tabulating equipment was again tested at approximately 7:30 p.m., before the official count of ballots to ascertain that the equipment correctly counted the precinct and absentee votes cast for all City of Miami candidates and referendum question. C. At the completion of the tabulation of election results, approximately 1:21 a.m., November 3, 2010, the Miami -Dade County Supervisor of Elections presented me with the certification of the un-official results of the elections tabulation. IV. I further certify that all documents concerning the above Logic and Accuracy Tests showed the tabulating equipment to be functioning correctly and that said documents are presently in the possession of the Supervisor of Elections of Miami -Dade County, in a container which were sealed under seal number 434 and signed off by the Supervisor of Elections. V. Dunn II received more than 50 percent plus one of all votes cast and is hereby declared to have been elected City of Miami District 5 Commissioner; and • the City of Miami Charter Amendment Question 1 was not approved by the electorate.
