HomeMy WebLinkAboutR-10-0490City of Miami Legislation Resolution: R-10-0490 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01207 Final Action Date: 10/28/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING AN ADDITIONAL CONTINGENCY ALLOWANCE TO GULF BUILDING, LLC, FOR ADDITIONAL WORK NECESSARY FOR THE PROJECT ENTITLED "ROBERTO CLEMENTE PARK RECREATION BUILDING", B-30172A, INCLUDING THE BUILD -OUT OF AN UNUSED TENANT AREA OF THE DOROTHY QUINTANA COMMUNITY CENTER WHICH WILL BE USED TO PROVIDE SERVICES TO THE ELDERLY COMMUNITY, IN THE AMOUNT NOT TO EXCEED $145,000, THEREBY INCREASING THE TOTAL AWARD AMOUNT FROM $2,192,439 TO A TOTAL AMOUNT NOT TO EXCEED $2,337,439; ALLOCATING FUNDS IN THE AMOUNT OF $145,000 FROM CAPITAL IMPROVEMENT PROJECT NO. B-30172A. WHEREAS, twenty seven (27) bids were received by the Office of the City Clerk on February 11, 2009, pursuant to formal Invitation for Bids No. 08-09-020, issued December 22, 2008, for the "Roberto Clemente Park Recreation Building," B-30172A, for the construction of the Dorothy Quintana Community Center; and WHEREAS, the City Manager approved the award of a contract to Gulf Building Corp., the lowest responsive and responsible bidder, on March 12, 2009, in the amount of $1,750,000, plus an additional owner contingency allowance of $175,000, for a total not to exceed award amount of $1,925,000, pursuant to the City of Miami's ("City's") Expedited List and Ordinance No. 13045; and WHEREAS, on September 23, 2010, the City Commission adopted Resolution No. 10-0415, authorizing Amendment No. 1, which increased the award amount by $267,439, from $1,925,000, to a total not to exceed award amount of $2,192,439, for additional work which included Leadership in Energy and Environmental Design (LEED) implementation and furnishing and installation of new playground equipment; and WHEREAS, Gulf Building, LLC is the successor entity to Gulf Building Corp., which was converted in the Official Records of the Secretary of State to Gulf Building, LLC, a Florida Limited Liability Company, on April 15, 2010; and WHEREAS, the requested additional contingency allowance will cover the additional work necessary for the build -out of the existing tenant area at Dorothy Quintana Community Center; and WHEREAS, the contingency allowance, as amended, is intended to cover unpredictable or unforeseen items in the work which are subsequently required by the City as owner; and WHEREAS, the build -out space will be used to house the De Hostos Senior Center, Inc., a non-profit organization which provides meals to the elderly within the City; and WHEREAS, funds are to be allocated from Capital Improvement Project No. B-30172A; City of Miami Page 1 of 2 File Id: 10-01207 (Version: 1) Printed On: 8/11/2017 File Number: 10-01207 Enactment Number: R-10-0490 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An additional contingency allowance to Gulf Building, LLC, for additional work necessary for the project entitled "Roberto Clemente Park Recreation Building", B-30172A, including the build -out of an unused tenant area of the Dorothy Quintana Community Center which will be used to provide services to the elderly community, in the amount not to exceed $145,000, thereby increasing the total award amount from $2,192,439 to a total amount not to exceed $2,337,439, is authorized, with funds in the amount of $145,000, allocated from Capital Improvement Project No. B-30172A. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
