HomeMy WebLinkAboutR-10-0481City of Miami Legislation Resolution: R-10-0481 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01167 Final Action Date: 10/28/2010 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), CLASSIFYING ONE TRAKEHNER HORSE KNOWN AS "BIGSCHO," AS "CATEGORY A" SURPLUS STOCK; FURTHER STIPULATING THAT SAID HORSE BE DONATED TO DAVID PATTON AT NO COST TO THE CITY OF MIAMI AND THAT SAID DONATION BE VALID AND EFFECTIVE IMMEDIATELY, UPON THE EXECUTION OF THE HORSE ADOPTION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND ANY OTHER APPROPRIATE RELEASE DOCUMENTS. WHEREAS, the City of Miami's ("City's") Department of Police Mounted Patrol Detail has a horse known as "BigScho," which has behavioral difficulties preventing this horse from being suitable for the Mounted Patrol Detail and is consequently no longer beneficial to the City; and WHEREAS, "BigScho" has a tendency to become excited, offensive and unruly in patrol formation, which poses a safety issue; and WHEREAS, the original donor was unreachable by telephone or through certified letter; therefore, waiving all owner's rights and interest in the horse and further allowing the City's Department of Police Mounted Patrol Detail to find a suitable home for the horse; and WHEREAS, David Patton will keep the horse at a stable in the Redlands (Homestead, Florida) that consists of 5 acres of land which would be ideal for a horse with "BigScho's" condition and has indicated a desire to care for the horse; and WHEREAS, David Patton has agreed to be responsible for all arrangements to transport "BigScho" to said horse stable at no expense to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. One Trakehner horse known as "BigScho," is classified as "Category A" surplus stock. Section 3. It is further stipulated that the horse be donated to David Patton and that said donation be valid and effective immediately upon execution of the Horse Adoption Agreement, in substantially the attached form, and any other appropriate release documents. Section 4.
