HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 10-01260 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A REINSTATEMENT, CONTINUATION, EXTENSION, AND AMENDMENT FROM AUGUST 1, 2010 UNTIL OCTOBER 31, 2010 AND ADDITIONAL FUNDING, IN THE NOT TO EXCEED AMOUNT OF ONE HUNDRED AND FIFTY THOUSAND DOLLARS ($150,000) (THE "EXTENSION GRANT"), RELATING TO THE EXISTING REIMBURSEMENT GRANT, IN THE NOT TO EXCEED AMOUNT OF SIX HUNDRED THOUSAND DOLLARS ($600,000) ("SCHOOL YEAR 2009-2010 GRANT"), FROM THE CHILDREN'S TRUST (THE "TRUST"), FOR THE SERVICE PARTNERSHIPS PROGRAM TO THE CITY OF MIAMI ("CITY") FOR THE CONTINUATION AND EXPANSION OF THE CITY'S TRUANCY REDUCTION SERVICE PARTNERSHIP PROGRAM DURING THE 2009-2010 SCHOOL YEAR (THE "PROGRAM"); AUTHORIZING ACCEPTANCE OF THE EXTENSION GRANT FUNDING INTO AND APPROPRIATION FROM THE EXISTING SPECIAL REVENUE FUND ENTITLED: "THE CHILDREN'S TRUST SERVICE PARTNERSHIP GRANT FOR PARKS," TO FUND THE PROGRAM BY APPROPRIATING FUNDS, IN THE EXTENSION GRANT AMOUNT NOT TO EXCEED ONE HUNDRED AND FIFTY THOUSAND DOLLARS ($150,000); FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT #001 WITH THE TRUST, IN SUBSTANTIALLY THE ATTACHED FORM (THE "AMENDMENT #001 TO THE TRUST CONTRACT"), FOR SAID PURPOSES, AND TO EXECUTE ALL OTHER NECESSARY DOCUMENTS, AFTER CONSULTATION WITH THE CITY ATTORNEY, TO IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE EXTENSION GRANT AWARD FOR SAID PURPOSES; ADDITIONALLY, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE, AFTER CONSULTATION WITH THE CITY ATTORNEY, ANY RELATED EXTENSION/AMENDMENTS TO THE EXISTING PROFESSIONAL SERVICES AGREEMENTS WITH NOT -FOR -PROFIT SERVICE PROVIDERS AND THE EXISTING INTERLOCAL AGREEMENTS WITH MIAMI-DADE COUNTY PUBLIC SCHOOLS AND WITH THE 11TH JUDICIAL CIRCUIT COURT, ALL IN COMPLIANCE WITH THE ATTACHED FORM OF AMENDMENT #001 TO THE TRUST CONTRACT, FOR A PERIOD COMMENCING AUGUST 1, 2010 THROUGH OCTOBER 31, 2010, AS NECESSARY UNDER THE SCHOOL YEAR 2009-2010 GRANT AND THE EXTENSION GRANT. WHEREAS, the City of Miami's ("City") Department of Parks and Recreation (the "Parks Department") was previously awarded by The Children's Trust (the "Trust") a continuation reimbursement grant for the 2009-2010 School Year through July 31, 2010, in the not to exceed amount of Six Hundred Thousand Dollars ($600,000) (the "School Year 2009-2010 Grant"), for the City's Truancy Reduction Service Partnership Program (the "Program"), and the City Commission pursuant to Resolution No. 09-0363, adopted July 23, 2009, authorized the execution of the award package for the Program, including a reimbursement grant contract with the Trust, to accept the moldi tV CD ,ED I-- --t C] LLJ City of Miami Page 1 of 3 File Id: 10-01260 (Version; 1) Printed On: 10/27/2010 File Number: 10-01260 School Year 2009-2010 Grant; and WHEREAS, the Program iacomprised ofacooperative effort between the Parks Department, the City's Office of the Mayor, Miami -Dade County Public Schools, the 1 1th Judicial Circuit Court, and five (5)community-based organizations for its successful implementation; and WHEREAS, the goals of the Program are tojoin efforts to connect the home, school and community hnensure that children acquire the necessary skills for success intheir adult life, authat they are able to compete in a global economy; and WHEREAS, accordingly, the City has now been awarded a reinstatement, continuation, extension, and amendment of the School Year 2009-2010 Grant in the not to exceed amount of One Hundred and Fifty Thousand Dollars ($150,000) for the period from August 1, 2010 through October 31, 2010 (the "Extension Grant"); and WHEREAS, the City must execute anaward package, including onew form of extension/amendment to the original Trust contract (the "Amendment #001tuthe Trust ContranC').to onue[t the Extension Grant and in order to enter into any related amend ments/exte nsions to the professional services agreements with nnt-for-pmfitommioapmvidmmandthere/atedinhedona| agreements with Miami -Dade County Public Schools and the 1 1th Judicial Circuit Court in order to comply with the Trust's requirements; and WHEREAS, itiuinthe best interests ofthe City for the City Commission also ooauthorize the City Manager tnnegotiate and toexecute, subject tnreview with the City Attorney, any extensions/amendments authorized by the Trust for the Program under the related professional services agreements with not -for -profit services providers and the related interlocal agreements with the Miami -Dade County Public Schools and the 11 th Judicial Circuit Court; NOW, THEREFORE, BE|TRESOLVED BYTHE COMMISSION OFTHE CITY OFMIAM|. Section 1. The recitals and findings contained in the Preamble ofthis Resolution are adopted by reference and incorporated as if fully set forth in this Section, Section 2. The City Manager is authorized (1) to accept a reinstatement, continuation, extension, and amendment from August 1, 2010 until October 31, 2010 and additional funding in the not to exceed amount of One Hundred and Fifty Thousand Dollars ($150,000) (the "Extension Grant"), relating to the existing reimbursement grant in the not to exceed amount of Six Hundred Thousand Dollars ($8OU.00O)(the "School Year 2O09'2U10Gmn1^)from The Chi)den'mTrust (the '7iust")for the Service Partnerships Program to the City for the continuation and expansion of the City's Truancy Reduction Service Partnership Program during the 2009-2010 School Year (the "Program"). Soction3. The City Manager is authorized (1) to accept the Extension Grant funding into and to appnzphate8omtheexioUngSpecio|RevenueFundentitled^TheChiNren'mTmatSenvioePertnership Grant for Parks" 10fund the Program by appropriating funds in the Extension Grant amount not to exceed One Hundred and Fifty Thousand Dollars ($15U.00U). Section 4. The City Manager is further authorized (1) to execute an Amendment #001 with the City of3fiami Page 2 of 3 File Id., 10-01260 (Version. 1) Printed On: 1012712010 File Number., 10-01260 and to execute all other necessary documents, after consultation with the City Attorney, to implement the acceptance of and compliance with the Extension Grant award for said purposes. Section 5. The City Manager is additionally authorized (11 to negotiate and to execute, after consultation with the City Attorney, any related extension/amendments to the existing professional services agreements with not -for -profit service providers and the existing interlocal agreements with Miami -Dade County Public Schools and with the 11th Judicial Circuit Court, all in compliance with the attached form of Amendment #001 to the Trust Contract, for a period commencing August 1, 2010 through October 31, 2010, as necessary under the School Year 2009-2010 Grant and the Extension SeodonG. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2) APPROVED AS TO FORM AND CORRECTNESS: JUUEO.BRU CITY ATTORNEY {1}The herein authorization iufurther subject 0ocompliance with all requirements that may beimposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions.
