2011 STATE LEGISLATIVE PRIORITIES
HOME RULE
SUPPORT the preservation of local home rule and OPPOSE. any effort to preempt local
authority.
PENSION REFORM
MONITOR legislative developments regarding pension/retirement reform during the 2011
Florida Legislative Session.
ALF SECURITY
AMEND s. 394.674 to require certain assisted living facilities or community residential homes,
within an area zoned residential, that serve residents with severe and persistent mental illness
and/or substance abuse disorder to maintain 24-hour security services.
NARCOTICS SALES NEAR HOMELESS SHELTERS
AMEND §893.13(1)(c) Florida Statutes to enhance the penalty for the sale or possession of
narcotics within 1,000 feet of a homeless shelter. Presently, the statue increases the penalty for
the sale of a controlled substance and possession with intent to sell when the violation of the law
occurs within 1000 feet of a school or child care facility during operating hours. The purpose of
the enhanced penalty is to protect school age children from the dangers of narcotics activity due
to their vulnerability.
Many homeless individuals are equally vulnerable to the dangers of narcotics activity. Many are
homeless due to a present or former dependency on illegal drugs. We should be able to include
the homeless as part of a vulnerable population that needs this extra protection from criminals
that prey on them. Therefore, the statute should be amended to increase the penalty for selling or
possessing illegal controlled substances within a 1000 foot radius of a homeless shelter.
STREET NAMING
SUPPORT the co -designation of (1) Southwest 27th Avenue from Southwest 8th Street to
Southwest 13th Street, Miami, Florida, as "Reverend Max Salvadore Avenue" and (2) Southwest
8th Street from Southwest 10th Avenue to Southwest 12th Avenue, Miami, Florida, as
"BRIGADA 2506 STREET, Carlos Rodriguez Santana".
TRANSIT SURTAX
SUPPORT legislation that clarifies the effect of the FY10 Florida transit surtax legislation on existing
interlocal agreements between cities and counties.
LOCAL FUEL TAX OPTION
SUPPORT legislation that eliminates the ambiguity in conflicting Attorney General Opinions
concerning the Local Fuel Tax Option.
COPPER THEFT
AMEND State law regulating metal dealers and require metal dealers to report transactions of
regulated metals to law enforcement within 24 hours in order to impede the sale of stolen copper.
SOUATTERS
AMEND State Law in order to provide homeowner associations the means to more effectively
address and resolve the problem of squatters living in properties that are abandoned and/or
subject to foreclosure.
CODE ENFORCEMENT BOARD
AMEND Florida Statutes governing the qualifications for a person to serve on a (local) Code
Enforcement Board so that state qualifications more closely mirror the City's qualifications for a
person to serve on a City advisory board.
WORKERS' COMPENSATION
AMEND Chapter 440, Florida Statutes in response to recent court rulings that negatively affect
local governments defending workers' compensation cases.
CLAIMS BILLS
OPPOSE claims bills sought during the 2011 Florida Legislative Session against the City of
Miami.
FUNDING FOR SOCIAL SERVICES FOR SENIORS
SUPPORT funding of social services for seniors, in the State's budget, equal to or greater than
last year's funding level.
HOMEBUYER ASSISTANCE
SUPPORT legislation that assists prospective homeowners purchase a home.
UNFUNDED MANDATES
OPPOSE all unfunded mandates.
