REQUEST
The proposal is for a change to the 2020 Future Land Use Map of the Miami Comprehensive
Neighborhood Plan from "Single Family" and "Duplex Residential" to "Major Institutional,
Public Facilities, Transportation and Utilities". (A complete legal description is on file at the
Hearing Boards Office).
FUTURE LAND USE
Miami Comprehensive Neighborhood Plan (MCNP) Policy LU-1.6.1 established future land use
categories according to the 2020 Future Land Use Plan Map and the "Interpretation of the Future
Land Use Plan Map."
Single Family Residential: Areas designated as "Single Family Residential" allow single family
structures of one dwelling unit each to a maximum density of 9 dwelling units per acre, subject
to the detailed provisions of the applicable land development regulations and the maintenance of
required levels of service for facilities and services included in the City's adopted concurrency
management requirements.
Supporting services such as foster homes and family day care homes for children and/or adults;
and community based residential facilities (6 clients or less, not including drug, alcohol or cor-
rectional rehabilitation facilities also will be allowed pursuant to applicable state law. Places of
worship, primary and secondary schools, child day care centers and adult day care centers are
permissible in suitable locations within single family residential areas.
Professional offices, tourist and guest homes, museums, and private clubs or lodges are allowed
only in contributing structures within historic sites or historic districts that have been designated
by the Historical and Environmental Preservation Board and are in suitable locations within sin-
gle family residential areas, pursuant to applicable land development regulations and the main-
tenance of required levels of service for such uses. Density and intensity limitations for said uses
shall be restricted to those of the contributing structure(s).
Duplex Residential: Areas designated as "Duplex Residential" allow residential structures of up
to two dwelling units each to a maximum density of 18 dwelling units per acre, subject to the
detailed provisions of the applicable land development regulations and the maintenance of re-
quired levels of service for facilities and services included in the City's adopted concurrency
management requirements.
Community based residential facilities (14 clients or less, not including drug, alcohol or correc-
tional rehabilitation facilities) also will be allowed pursuant to applicable state law. Places of

Major Institutional, Public Facilities, Transportation and Utilities: Areas designated as "Ma-
jor Institutional, Public Facilities, Transportation and Utilities" allow facilities for federal, state
and local government activities, major public or private health, recreational, cultural, religious or
educational activities, and major transportation facilities and public utilities. Residential facilities
ancillary to these uses are allowed up to a maximum density equivalent to "High Density Multi-
family Residential" or if applicable the least intense abutting/adjacent residential zoning district,
subject to the same limiting conditions.
Areas designated as "Major Institutional, Public Facilities, Transportation and Utilities" allow a
maximum floor area ratio (FAR) of 1.72 times the gross lot area of the subject property; such
FAR may be increased upon compliance with the detailed provisions of the applicable land de-
velopment regulations; however, may not exceed a total FAR of 3.0 times the gross lot area of
the subject property, except within the Health / Civic Center District where it may not exceed a
total FAR of 3.2 times the gross lot area of the subject property.
All such uses and mixes of uses shall be subject to the detailed provisions of the applicable land
development regulations and the maintenance of required levels of service for facilities and ser-
vices included in the City's adopted concurrency management requirements.
DISCUSSION
The subject area consists of 11 parcels comprising approximately 1.43 acres. The parcels are
located within the block bounded by SW 6 Street to the south, SW 27 Avenue to the west, SW
5t' Street to the north and SW 25 Avenue to the east. The sites are currently designated "Single
Family Residential" and "Duplex Residential". Surrounding the subject sites are the following
land use designations: "Single Family Residential" to the north, Duplex Residential to the east,
"Major Institutional, Public Facilities, Transportation and Utilities" to the west and south, as
well as "Office", and "Medium Density Multifamily Residential" also to the south. The subject
site is in the West Flagler NET area.

ANALYSIS
The Planning Department is recommending DENIAL of the application as presented based
on the following findings:
• The parcels are part of a Single Family and Duplex Residential areas.
• The requested change will represent an intrusion of Major Institutional, Public Facilities,
Transportation and Utilities uses into the residential designation area.
• A land use change at this location may set a negative precedent and create a "domino effect"
in regards to future land use change applications.
• The "Single Family Residential" and "Duplex Residential" and land use categories allow
residential structures to a maximum density of 9 and 18 dwelling units per acre respectively.
The requested "Major Institutional, Public Facilities, Transportation and Utilities" de-
signation at this location allows to the least intense abutting/adjacent residential zoning dis-
trict, or to 9 dwelling units per acre. This density could change if the surrounding zoning
districts changes to allow more density.
• MCNP Land Use Goal LU-1(1) encourages a land use pattern that protects and enhances the
quality of life in the city's residential neighborhoods, and (5) promotes the efficient use of
land and minimizes land use conflicts. A change to Major Institutional, Public Facilities,
Transportation and Utilities is not a logical extension of that category.
• MCNP Policy LU-1.1.3 (1) provides for the protection of all areas of the city from: (1) the
encroachment of incompatible land uses; (2) the adverse impacts of future land uses in
adjacent areas that disrupt or degrade public health and safety, or natural or man-made
amenities;
• MCNP Housing Policy HO-1.1.8 states that through land development regulations, the City
will protect and enhance existing viable neighborhoods in those areas suitable for housing.
• MCNP Land Use Policy 1.1.1 provides that new development or redevelopment that results
in an increase in density or intensity of land use shall be contingent upon availability of
public facilities and services that meet or exceed the minimum LOS standards adopted in the
Capital Improvement Element.
These findings support the position that the Future Land Use Map at this location should not be
changed.

ASSUMPTIONS AND COMMENTS
Population increment is assumed to be all new residents. Peak -period trip
generation is based on ITE Trip Generation, 5th Edition at 1.4 ppv average
occupancy for private passenger vehicles. Transportation Corridor capacities and
LOS are from Table PT-2(R1), Transportation Corridors report.
Potable water and wastewater transmission capacities are in accordance with
Metro -Dade County stated capacities and are assumed correct. Service
connections to water and sewer mains are assumed to be of adequate size; if not,
new connections are to be installed at owner's expense.
Recreation/Open Space acreage requirements are assumed with proposed
change made.

A RESOLUTION OF THE MIAMI PLANNING ADVISORY BOARD
RECOMMENDING APPROVAL OR DENIAL OF AN ORDINANCE OF THE MIAMI
CITY COMMISSION, WITH ATTACHMENT(S), AMENDING ORDINANCE NO.
10544, AS AMENDED, THE FUTURE LAND USE MAP OF THE MIAMI
COMPREHENSIVE NEIGHBORHOOD PLAN, PURSUANT TO SMALL SCALE
AMENDMENT PROCEDURES SUBJECT TO §163.3187, FLORIDA STATUTES, BY
CHANGING THE LAND USE DESIGNATION OF THE ACREAGE DESCRIBED
HEREIN OF REAL PROPERTIES LOCATED AT APPROXIMATELY 2508, 2524,
2534, 2538, 2590, 2600, 2610, AND 2620 SOUTHWEST 5TH STREET, MIAMI,
FLORIDA, FROM "SINGLE-FAMILY RESIDENTIAL" AND "DUPLEX RESIDENTIAL"
TO "MAJOR INSTITUTIONAL, PUBLIC FACILITIES, TRANSPORTATION AND
UTILITIES"; MAKING FINDINGS; DIRECTING TRANSMITTALS TO AFFECTED
AGENCIES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting on March 18, 2009, Item No.
P.1, following an advertised public hearing, adopted Resolution No. by a vote of to
recommending of an amendment to Ordinance No. 10544, as amended
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted
by reference and incorporated as if fully set forth in this Section.
Section 2. The Future Land Use Map of Ordinance No.10544, as amended, the Miami
Comprehensive Neighborhood Plan, pursuant to small scale amendment procedures subject to §
163.3187, Florida Statutes, is hereby amended by changing the land use designation from Single
Family Residential: Duplex Residential to Major Institutional, Public Facilities, Transportation and
Utilities for 1.43± acres of real property located at approximately 2508, 2524, 2534, 2538, 2590, 2600,
2610, 2620 SW 5th Street, Miami, Florida, more particularly described in Exhibit "A" attached hereto
and made a part thereof.
Section 3. It is found that this Comprehensive Plan designation change:
(a) is necessary due to changed or changing conditions;
(b) is one which involves property that has not been the specific subject of a Comprehensive
Plan change within the prior twelve months;
(c) is one which does not involve the same owner's property within 200 feet of property that
has been granted a Comprehensive Plan change within the prior twelve months;

(d) the proposed amendment does not involve a text change to goals, policies, and objectives
of the local government's comprehensive plan, but proposes a land use change to the future land use
map for a site -specific development;
(e) is one which is not located within an area of critical state concern, unless the project
subject to the proposed amendment involves the construction of affordable housing units meeting the
criteria of § 420.0004(3), Florida Statutes, and is located within an area of critical state concern
designated by § 380.0552, Florida Statutes or by the Administration Commission pursuant to §
380.05(1), Florida Statutes. Such amendment is not subject to the density limitations of
sub -subparagraph f., and shall be reviewed by the state land planning agency for consistency with the
principles for guiding development applicable to the area of critical state concern where the
amendment is located and shall not become effective until a final order is issued under § 380.05(6),
Florida Statutes; and
(f) density will be Major Institutional, Public Facilities, Transportation and Utilities, 150 dwelling
units per acre, as per the Miami Neighborhood Comprehensive Plan, as amended, and intensity will be
as established in Article 4, Section 4.01, G/I Government and Institutional of the City of Miami Zoning
Ordinance 11000, as amended.
(g) the proposed amendment complies with the applicable acreage and density limitations set
forth in the Local Government Comprehensive Planning and Land Development Regulation Act
including, without limitation, § 163.3187, Florida Statutes.
Section 4. The City Manager is directed to instruct the Director of the Planning Department to
promptly transmit a certified copy of this Ordinance after its adoption on second reading to: the
Secretary, Florida Department of Community Affairs; the Executive Director, South Florida Regional
Planning Council, Hollywood, Florida; and any other person or entity requesting a copy.
Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict
with the provisions of this Ordinance are repealed.
Section 6. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance shall become effective thirty-one (31) days after second reading
and adoption thereof pursuant and subject to § 163.3187(3)(c), Florida Statutes. {1}

LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST WITH THE CITY CLERK, PRIOR TO ENGAGING IN
LOBBYING ACTIVITIES BEFORE CITY STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A
COPY OF SAID ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL),
LOCATED AT 3500 PAN AMERICAN DRIVE, MIAMI, FLORIDA, 33133. Copies of lobbyist documentation
with proof of payment must be submitted with the complete application.
Ordinance No. 12918 states that each person or entity requesting approval, relief or other action from the City
Commission or any of its boards, authorities, agencies, councils or committees regarding any issue, shall disclose
at the commencement (or continuance) of the public hearing(s) on the issue, any consideration provided or
committed, directly or on its behalf, for an agreement to support or withhold objection to the requested approval,
relief or action. The Disclosure of Consideration Provided or Committed for Agreement to Support or
Withhold Objection Affidavit included in this package must be submitted with the application. The applicant
must, at the commencement of any public hearing on the issue, if there is any disclosure to report, read the
disclosure into the record. Also, the applicant must supplement the affidavit if there is any new information or
additional information to disclose.
The deadline to file the complete application with supporting documents is the first five working days (1-5) of
each month from 8:00 am until 3:00 pm, and on the fifth day, at 12:00 pm. The responses to this application
must be typed and signed in black ink. Please note that pursuant to Section 1304.2.2 of the Miami Zoning
Ordinance, no application shall be deemed to have been filed unless and until the applications shall have been
completed. All pertinent and accurate information/documentation; i.e., the plans, reports, exhibits, shall be
presented at the time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the
information contained in the application and all supporting materials. If you like, you could bring the materials to
our office for staff review before the deadline to ensure the application is complete. Upon submittal, this
application must be accompanied with a signed Zoning Referral.
You will be responsible, if needed, to bring an interpreter for the English language to any presentation before city
boards, committees and the city commission. A valid power of attorney will be required if neither applicant or
legal counsel representing the applicant execute the application or desire to make a presentation before city
boards, committees and the city commission.
