HomeMy WebLinkAboutCC Legislation (Version 3)City of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00169xt Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), GRANTING THE APPEAL, REVERSING THE DECISION OF THE ZONING BOARD AND THEREBY DENYING AN EXTENSION OF TIME FOR VARIANCES FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 19, SECTION 1901, ARTICLE 4, SECTION 401, TO ALLOW AN INTERIOR SIDE SETBACK (NORTH) OF 0'0" (15'0" REQUIRED); A STREET SIDE SETBACK (SOUTH) OF 4'6" (15'0" REQUIRED); AND A REAR SETBACK (WEST) OF 2'10" (7'6" REQUIRED), FOR THE PROPERTY LOCATED AT APPROXIMATELY 888 BRICKELL AVENUE, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board at its meeting on September 14, 2009, Item No. Z.3, GRANTED the extension of time for Variances, adopting Resolution No. ZB-R-09-0049 by a vote of four to two (4-2) as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, and notwithstanding the decision of the Zoning Board, finds the application for the extension of time of the Variances does not meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to reverse the decision of the Zoning Board and denies the extension of time of the Variances as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORI DA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The decision of the Zoning Board to grant the extension of time for Variances, as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, to allow an interior side setback (North) of 0'0" (15'0" required); a street side setback (South) of 4'6" (15'0" required); and a rear setback (West) of 2'10" (7'6" required), for the property located at approximately 888 Brickell Avenue, Miami, Florida is reversed. The appeal is granted and the Variances are denied. There is no good cause shown in the record at the public hearing for granting this extension. Section 3. BRU CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
