REFERENCES: City Manager ENCLOSURES: The March 26th City Commission agenda includes a discussion item relating to regulation fees and processes that are considered burdensome to businesses operating within the City. Specifically, concerns were raised at previous City Commission meetings relating to Miami- Dade County's Department of Environmental Resources (DERM) and Miami -Dade Water and Sewer Department's (MDWASD) role in the permitting process for properties/businesses within the City. It was noted that the permitting of a new business required multiple reviews and associated review fees that may be duplicative or not necessary, this resulting in delays to an approval and/or increased expense in obtaining the Certificate of Use (CU). in an effort to address these concerns and better streamline the permitting process, the following has been accomplished after discussions between key city staff, DERM and MDWASD. All governmental parties have agreed that only an entirely new use of property and/or higher intensity of use from what currently exists onsite will require consideration by DERM and MDWASD. DERM has provided the City's Zoning Department with a proposed list of uses that will require their review. The Zoning Department will work with DERM to finalize this list. In addition, the uses that will require DERM review will be accompanied by a copy of the properties' previous CU provided by the City. This will assist DERM in knowing the previous use and how it may compare to the proposed use. This may result in a reduction of the fee associated with any newly required permit. MDWASD is presently reviewing both their water and sewer agreement processes with city staff to determine what measures can be identified to reduce the need for multiple permits (resulting in multiple fees) and certain requirements under defined circumstances. MDWASD has agreed that if a property is required to increase their existing water line per code, the property owner may opt to perform a fire flow test. If the test determines that the pressure meets with fire requirements, the property owner will not be required to upgrade the line. Staff is continuing to work with the Department on modifications to sewer agreement procedures which can be instituted that would reduce the burden on businesses when acquiring a new CU.
