The City of Miami has three (3) water trucks in the City fleet. One is assigned to each of the
following Departments: Public Works, Parks and Recreations, and Solid Waste.
All watering trucks are in good working condition. Should one water truck need repair, the
other departments share the equipment, as needed. •
As part of the Capital Improvement design process, the Public Works Department reviews
the plans for maintenance related issues. Public Works ensures that CIP designers utilize
Xeriscape principals for landscaping public rights of way. Xeriscape is quality landscaping
that conserves water and protects the environment. The main objective of Xeriscape is to
establish and maintain a healthy landscape by matching the right plants with existing site
conditions so that use of additional resources such as water, fertilizer, pesticides and labor
are minimized. The Department currently follows the South Florida Edition of Waterwise
published by the South Florida Water Management District. In roadways where Xeriscape is
not used, irrigation must be provided.
Since the roadways are designed and constructed using Xeriscape principals, once the
establishment period is completed, watering is not required and as such there is no set
watering schedule.
Apart from plantings that the Capital Improvement Department manages, other planting
events are performed by Community Volunteers and directly by Public Works Department
staff. In these cases, the Public Works department waters the trees for a minimum of one
month in the dry season and/or until the next steady rainfall event in the rainy season.
Groundcover is watered by the Department until the plants are fully established. Watering is
also done citywide on an as requested basis.
The Parks Department uses their water truck to maintain the athletic fields and
plants/vegetation within city parks. Solid Waste uses their water truck to wash streets at
night and to wash down areas after special events.

Standard Existing CIP contract provisions
CIP's contract provisions for landscaping are as follows:
The contractor is required to provide a warranty on all landscape material for one year.
Furthermore, it is the contractor's responsibility to water and fertilize as necessary in order to
establish the landscape material. If landscape material dies within the one year period for
reasons other than by a vehicle accident or "acts of God", the contractor is responsible for
replacing the landscape material and a new 1 year warranty starts. This provision also
applies to "unsatisfactory growth". The warranty becomes effective upon "substantial
completion".
In the event the contractor fails to perform in accordance with the contract provisions, e.g.
warranty period requirements, the City can seek remedy through the contractor's
performance bond. This is also applicable in the case of bankruptcy. Moreover, the City
also has the option of precluding the contractor from receiving future City contracts.
Proposed Modification to Standard_Contract Language
In order to further strengthen the contract provisions we plan to add the following revisions:
"The determination of the trees and shrub conditions will be at the City's sole discretion and
not subject to the Contractor's opinion".
In addition, the commencement of the warranty period will be changed to start at "final
completion" as opposed to "substantial completion". This will provide the City a minimum of
an additional thirty (30) days to evaluate the condition of the landscape materials.
