AUTHORIZING THE TRANSFER OF EMERGENCY RENTAL ASSISTANCE 2
("ERA2") FUNDS IN THE TOTAL AMOUNT NOT TO EXCEED $76,711.26 TO THE
CITY OF MIAMI, DEPARTMENT OF HUMAN SERVICES AS SPECIFIED IN THE
EXHIBIT "A" , ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE
CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO
ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH
FUNDS.
Background of Item:
On November 17, 2022, pursuant to Resolution No.22-0445 the Miami City Commission
authorized the acceptance of additional "ERA2" funds in the total amount of
$5,518,130.00 from United States Department of the Treasury to provide assistance to
eligible households through the existing City Emergency Rental Assistance program.
The ERA2 has ended, leaving an unspent balance of $76,711.26 and there is an urgent
need to transfer the unspent funds to the City of Miami ("City"), Department of Human
Services ("Human Services") to cover costs of hotel/motel accommodations for
individuals and families experiencing homelessness. The City's Administration
recommends transferring the unspent ERA2 funds in an amount not to exceed
$76,711.26 to Human Services, as more particularly specified in Exhibit "A," attached
and incorporated, to cover the costs of hotel/motel accommodations for individuals and
families experiencing homelessness.

OF MIAMI, DEPARTMENT OF HUMAN SERVICES, AS SPECIFIED IN EXHIBIT "A,"
ATTACHED AND INCORPORATED; FURTHER AUTHORIZING THE CITY MANAGER
TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, SUBJECT TO ALL FEDERAL,
STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS, FOR

WHEREAS, the ERA2 has ended, leaving an unspent balance of $76,711.26 and there
is an urgent need to transfer the unspent funds to the City of Miami ("City") Department of
Human Services ("Human Services") to cover costs of hotel/motel accommodations for
individuals and families experiencing homelessness; and
WHEREAS, the City's Administration recommends transferring the unspent ERA2 funds
in an amount not to exceed $76,711.26 to Human Services, as more particularly specified in
Exhibit "A," attached and incorporated, to cover the costs of hotel/motel accommodations for
individuals and families experiencing homelessness;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The transfer of unspent ERA2 funds, in an amount not to exceed $76,711.26,
to Human Services, as specified in Exhibit "A," attached, and incorporated, to cover the costs of
hotel/motel accommodations for individuals and families experiencing homelessness, is
authorized.'
Section 3. The City Manager is authorized to negotiate and execute any and all
necessary documents, all in forms acceptable to the City Attorney, for said purpose, subject to
all federal, state, and local laws that regulate the use of such funds.
1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
