Dear Teresita:
This law firm represents KEA Investments, LLC and Pacesetter Personnel Service,
Inc., the applicants in the above -captioned application requesting a Special Exception to
permit an employment office at the property located at 1757 N.W. 23 Street, Miami, Florida
("Application"). Pursuant to Article 20 of the City of Miami Zoning Code, this letter shall
serve to appeal the October 29, 2007 Zoning Board 5-4 decision to deny the Application to
the City Commission. The Zoning Board's decision was not based on the applicable
codified standards but on staff's arbitrary conclusion that the location for the proposed use
was inappropriate due to the proximity of a school as well as staff's statement that they had
received an email from the principal of the school objecting to the application. The email
was not in the hearing record and upon further investigation, the principal of the school
did not object to the application.
We understand that your office collected the appeal fee as part of the initial public
hearing application fee. Should you have any questions, comments or require additional
