Re: 1260 South Venetian Way - Height Variance
Dear Mrs. Fernandez:
This law firm represents 1276 Venetian LC, the owner of the home directly
abutting the property at 1260 South Venetian Way, which was the subject of a
public hearing approval by the Zoning Board on January 8, 2007. This letter shall
serve as 1276 Venetian LC's appeal to the City Commission from the decision of
the Zoning Board.
In support of the appeal, 1276 Venetian LC's position is that the Zoning
Board's decision was not based on substantial and competent evidence.
Furthermore, the applicant failed to demonstrate that there exists a legal
hardship that would justify the approval of a variance from the requirements of
the City of Miami Zoning Ordinance as they apply to the property.
On behalf of 1276 Venetian LC, we would appreciate your notifying us of
the date in which the City Commission will consider this appeal. Thank you for
your attention to this matter.
