("RMI"), the lowest responsive and responsible bidder, pursuant to Invitation to Bid ("ITB") No. 23-24-008 for South Bayshore Lane/Fairview Pump Station - Project No. B- 30737 ("Project"), for a total contract award value of Nine Million Six Hundred Fifty -Four Thousand Fifty -Seven Dollars and Fifty -Five Cents ($9,654,057.55), allocating funds from the Department of Resilience and Public Works ("RPW') Project No. B-30737, subject to budgetary approval at the time of need; authorizing the City Manager to execute an agreement with RMI, in a form acceptable to the City Attorney; further authorizing the City Manager to negotiate and execute all other documents, including any amendments and extensions subject to allocations, appropriations and budgetary approvals having been previously made, and in compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City's Procurement Ordinance, Anti -deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Background of Item: On November 30, 2023, the Department of Procurement ("Procurement") issued solicitation ITB No. 23-24-008 for South Bayshore Lane/Fairview Pump Station - Project No. B-30737, on behalf RPW, under full and open competition to procure construction services. On January 10, 2024, Procurement received two (2) bids in response to the ITB. RMI, the lowest bidder, was deemed responsive and responsible for the project following the guidelines set forth in the ITB. RPW reviewed and evaluated RMI's bid and compared it with a construction cost estimate prepared by A.D.A. Engineering, Inc., the Engineer of Record ("EOR"). On March 1, 2024, a Best and Final Offer (BAFO) Letter was sent to RMI, and a response was received on March 4, 2024. At the Negotiation Meeting on March 21, 2024, RPW discussed line items that exceeded the construction cost estimate with RMI. On April 16, 2024, RPW accepted RMI's bid proposal as reasonable based on current market conditions in the construction industry and recommended to award the Project to RMI, pending outcome of a Community Outreach meeting scheduled for May 16, 2024. On May 20, 2024, RPW cleared the contract award to move forward. Procurement hereby recommends that the bid received on January 10, 2024, from RMI, the lowest responsive and responsible bidder, for a contract amount of Eight Million Seven Hundred Seventy -Six Thousand Four Hundred Fifteen Dollars and Ninety -Five Cents ($8,776,415,95) for the Scope of Work, plus an Owner's Contingency Allowance in the amount of Eight Hundred Seventy -Seven Thousand Six Hundred Forty -One Dollars and Sixty Cents ($877,641.60) for a total contract value of Nine Million Six Hundred Fifty -Four Thousand Fifty -Seven Dollars and Fifty -Five Cents ($9,654,057.55). WHEREAS, on November 30, 2023, the City of Miami ("City") Procurement Department ("Procurement"), on behalf of the City's Resilience and Public Works ("RPW') Department, issued Invitation to Bid ("ITB") No. 23-24-008 for the provision of construction services for the South Bayshore Lane/Fairview Pump Station - Project No. B-30737 ("Project"), under full and open competition for the procurement of said services; and WHEREAS, on January 10, 2024, two (2) bids were received in response to the ITB; and WHEREAS, Ric -Man International, Inc., a Florida profit corporation ("RMI"), was deemed to be the lowest responsive and responsible bidder; and WHEREAS, the City Manager requests authorization to execute an agreement ("Agreement") with RMI in the amount of Eight Million Seven Hundred Seventy Six Thousand Four Hundred Fifteen Dollars and Ninety Five Cents ($8,776,415.95) for the scope of work for the Project, plus the amount of Eight Hundred Seventy Seven Thousand Six Hundred Forty One Dollars and Sixty Cents ($877,641.60) for the owner's contingency allowance, for a total contract award value of Nine Million Six Hundred Fifty Four Thousand Fifty Seven Dollars and Fifty Five Cents ($9,654,057.55); and WHEREAS, funds for said total contract award value are to be allocated from RPW Project No. B-30737; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The bid received on January 10, 2024, from the lowest responsive and responsible bidder, RMI, pursuant to ITB No. 23-24-008 for the provision of construction services for the South Bayshore Lane/Fairview Pump Station - Project No. B-30737 ("Project"), for a total contract award value of Nine Million Six Hundred Fifty -Four Thousand Fifty Seven Dollars and Fifty Five Cents ($9,654,057.55), is hereby accepted. Section 3. Funding shall be allocated from RPW Project No. B-30737, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to execute an Agreement with RMI, in a form acceptable to the City Attorney, for said purpose. Section 5. The City Manager is further authorized to negotiate and execute any and all other documents, including any amendments and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be deemed necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption.
