Subject: Authorize - NASPO Piggyback Contract
Purpose of Item:
A Resolution of the Miami City Commission Pursuant To Section 18-113 of the Code Of
The City of Miami, Florida, as Amended ("City Code"), authorizing the accessing of all
competitively solicited and awarded contracts available via the National Association of
State Procurement Officials ("NASPO") Cooperative, subject to any amendments,
renewals and extensions, new and replacement contracts by NASPO, to be utilized
Citywide on an as needed contractual basis, subject to the availability of funds and
budgetary approval at the time of need; acknowledging the cooperative procurement
benefits of NASPO, that enables the City Of Miami ("City"), as a Participating Entity, to
aggregate its purchasing volume with that of other participating member public
agencies, in order to realize a larger percentage discount pricing structure to the
financial benefit of the residents of the City; Further authorizing the City Manager to
negotiate and execute any and all documents, including any amendments, renewals,
extensions, new, or replacement contracts, subject to all allocations, appropriations and
budgetary approvals having been previously made, compliance with applicable
provisions of the code of the City of Miami, Florida, as amended, ("City Code"),
including, the City of Miami's Procurement Ordinance, Anti -Deficiency Act, and
Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form
acceptable to the City Attorney, and in compliance with all applicable laws, rules and
regulations, as may be deemed necessary for said purpose.
Background of Item:
NASPO offers all Participating Entities, free of charge, access to contracts which have
been competitively solicited and awarded by one of its participating member public
agencies. Furthermore, NASPO assists Participating Entities in reducing the costs of
purchasing goods and/or services by pooling together the purchasing power of all the
Participating Entities of which NASPO is comprised in order to realize a larger
percentage discount pricing structure to the benefit of the residents of all the
participating member public agencies.The adoption of this Resolution will enable the
Procurement Department the ability to purchase goods and services, on an as needed
contractual basis, on behalf of all the City of Miami ("City") Departments, by utilizing all
competitively solicited and awarded contracts available through NASPO, subject to the
availability of funds and budgetary approval at the time of need.

A RESOLUTION OF THE MIAMI CITY COMMISSION, ACKNOWLEDGING AND
ACCEPTING THE COOPERATIVE PROCUREMENT BENEFITS OF THE NATIONAL
ASSOCIATION OF STATE PROCUREMENT OFFICIALS ("NASPO"), A NON-PROFIT
ASSOCIATION DEDICATED TO ADVANCING PUBLIC PROCUREMENT THROUGH
LEADERSHIP, EXCELLENCE, AND INTEGRITY, THAT ENABLES THE CITY OF
MIAMI ("CITY"), AS ONE OF THE PARTICIPATING MEMBER PUBLIC ENTITIES
("PARTICIPATING PUBLIC ENTITIES"), TO AGGREGATE ITS PURCHASING
VOLUME WITH THAT OF OTHER PARTICIPATING PUBLIC ENTITIES, IN ORDER
TO REALIZE A LARGER PERCENTAGE DISCOUNT PRICING STRUCTURE FOR
THE FINANCIAL BENEFIT OF THE RESIDENTS OF ALL; PURSUANT TO SECTION
18-113 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY
CODE"), AUTHORIZING THE ACCESSING OF ALL COMPETITIVELY SOLICITED
AND AWARDED CONTRACTS AVAILABLE VIA NASPO, SUBJECT TO ANY
AMENDMENTS, RENEWALS, EXTENSIONS, NEW AND/OR REPLACEMENT
CONTRACTS BY NASPO, TO BE UTILIZED CITYWIDE ON AN AS NEEDED
CONTRACTUAL BASIS, SUBJECT TO THE AVAILABILITY OF FUNDS AND
BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS,
INCLUDING ANY AMENDMENTS, RENEWALS, EXTENSIONS, NEW AND/OR
REPLACEMENT CONTRACTS, SUBJECT TO ALL ALLOCATIONS,
APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL
APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING THE CITY'S
PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL
INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY
CODE, IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE
WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED
NECESSARY FOR SAID PURPOSE.
WHEREAS, the National Association of State Procurement Officials ("NASPO") is a non-
profit association dedicated to advancing public procurement through leadership, excellence,
and integrity; and
WHEREAS, NASPO offers all participating member public entities ("Participating Public
Entities"), free of charge, access to contracts which have been competitively solicited and
awarded by one of the same; and
WHEREAS, NASPO assists Participating Public Entities in reducing the costs of
purchasing goods and/or services by pooling together all of the purchasing power of all of the
same, and of which NASPO is comprised, in order to realize a larger percentage discount
pricing structure for the benefit of the residents of all; and
WHEREAS, Section 18-113 of the Code of the City of Miami, Florida, as amended ("City
Code"), titled "Cooperative Purchasing," expressly allows the City of Miami ("City") Procurement
Department ("Procurement") to participate in, sponsor, conduct, or administer cooperative
purchasing agreements for the procurement of any goods and services, such as provided by
NASPO with other Participating Public Entities; and
WHEREAS, the adoption of this Resolution will provide Procurement with the ability to
purchase goods and services, on an as needed contractual basis, on behalf of all City
departments, by utilizing all competitively solicited and awarded contracts available through
NASPO, subject to the availability of funds and budgetary approval at the time of need;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The cooperative procurement benefits of NASPO, a non-profit association
dedicated to advancing public procurement through leadership, excellence, and integrity, that
enables the City, as one of the Participating Public Entities, to aggregate its purchasing volume
with that of other Participating Public Entities, in order to realize a larger percentage discount
pricing structure for the financial benefit of the residents of all, is hereby acknowledged and
accepted.
Section 3. Pursuant to Section 18-113 of the City Code, the accessing of all
competitively solicited and awarded contracts available via NASPO, subject to any
amendments, renewals, extensions, new and/or replacement contracts by NASPO, to be
utilized Citywide on an as needed contractual basis, subject to the availability of funds and
budgetary approval at the time of need, is hereby authorized.1
Section 4. The City Manager is authorized' to negotiate and execute any and all
documents, including any amendments, renewals, extensions, new and/or replacement
contracts, subject to all allocations, appropriations, prior budgetary approvals, compliance with
all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -
Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code,
in forms acceptable to the City Attorney, and in compliance with all applicable laws, rules, and
regulations, as may be deemed necessary for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.

Pursuant to the resolution, this item became effective immediately upon adoption by the Commission.
