A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
APPROVING THE RELEASE OF A TEN-YEAR AFFORDABILITY RESTRICTIVE
COVENANT FOR TEN PARCELS OF LAND, DESCRIBED IN "ATTACHMENT A",
ATTACHED AND INCORPORATED, THAT ARE BEING DEVELOPED FOR
AFFORDABLE HOUSING; AUTHORIZING A THIRTY-YEAR AFFORDABILITY
RESTRICTIVE COVENANT TO BE ENFORCED BY HABITAT FOR HUMANITY OF
GREATER MIAMI, INC., FOR SAID TEN PARCELS OF LAND; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE A PARTIAL RELEASE OF
DECLARATION OF RESTRICTIVE COVENANTS, IN SUBSTANTIALLY THE
ATTACHED FORM, AND ANY NECESSARY DOCUMENT(S), FOR SAID
PURPOSE.
WHEREAS, the ten parcels of land have a ten-year affordability restrictive covenant; and
WHEREAS, a new covenant will be enforced by Habitat for Humanity of Greater Miami, Inc.,
protecting the City of Miami ("City") with a thirty-year affordability covenant for the said ten parcels of
land;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The release of a ten-year affordability restrictive covenant for ten parcels of land,
described in "Attachment A," attached and incorporated, that are being developed for affordable
housing, is approved.
Section 3. A thirty-year affordability restrictive covenant to•be enforced by Habitat for Humanity of
Greater Miami, Inc., for said ten parcels of land, is authorized.. Habitat for Humanity of Greater Miami,
Inc., shall promptly prepare and record such covenant and furnish a recorded copy to the City
Manager.
Section 4. The City Manager is authorized{1} to execute a Partial Release of Declaration of
Restrictive Covenants, in substantially the attached form, and any necessary document(s), for said
purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
