HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 05-00988 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING THE RECOMMENDATION OF THE ACTING DIRECTOR OF THE DEPARTMENT ECONOMIC DEVELOPMENT'S DECISION TO REJECT MIAMI RIVER LOBSTER AND STONE CRAB CORPORATION'S PROTEST OF THE RECOMMENDATION BY THE EVALUATION COMMITTEE, FOR THE REQUEST FOR LETTERS OF INTEREST SOLICITATION, FOR USE OF 236 SOUTHWEST NORTH RIVER DRIVE, MIAMI, FLORIDA, AS SUCH PROTEST HAS BEEN DETERMINED TO BE WITHOUT MERIT. WHEREAS, the City of Miami ("City") issued and solicited proposals for a Request for Letters of Interest ("RFLI") on April 22, 2005, for the use of 236 Southwest North River Drive, Miami, Florida; and WHEREAS, on May 13, 2005, the City received four (4) responses to said RFLI solicitation; and WHEREAS, on June 6, 2005, the Evaluation Committee chosen by the City Manager selected Garcia Brothers Wholesale, Inc. ("Garcia Brothers") as the highest -ranked proposer and the City Manager later concurred with this recommendation; and WHEREAS, on July 11, 2005, Miami River Lobster and Stone Crab Corporation ("Miami River Lobster"), a RFLI respondent, submitted a combined Letter of Intent to Protest and Protest Letter which alleges four (4) grounds for challenging the scoring and selection of Garcia Brothers by the Evaluation Committee as the highest -ranked RFLI proposer and the concurring recommendation by the City Manager; and WHEREAS, pursuant to Section 18-176.3 of the Code of the City of Miami, Florida, as amended ("City Code"), the Acting Director of the Department of Economic Development has the delegated authority to handle RFLI protests in real property awards; and WHEREAS, pursuant to 18-104(b) of the City Code, the Acting Director of the Department of Economic Development has determined that the protest lacked merit; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The recommendation of the Acting Director of the Department of Economic Development's decision to reject Miami River Lobster's protest of the recommendation by the Evaluation Committee for the RFLI solicitation, for use of 236 Southwest North River Drive, Miami, Florida, is approved, as such protest has been determined to be without merit, City of Miami Page 1 of 2 Printed On: 9/12/2005 File Number: 05-00988 Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1 } APPROVED AS TO FORM AND CORRECTNESS: FERNANDEZ RNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
