AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
CHAPTER 12.5/ARTICLE I/ENTITLED "COMMUNITY REVITALIZATION
DISTRICTS," DIVISION 2, ENTITLED "MODEL CITY COMMUNITY REVITALIZATION
DISTRICT TRUST" OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE") BY SETTING FORTH PROCEDURES FOR
APPOINTMENT OF BOARD MEMBERS PROVISIONS OF SAID CODE;
CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 12082, adopted July 10, 2001, created the Model City
Homeownership Trust; and
WHEREAS, Ordinance No. 12257, adopted July 9, 2002, changed the name of the Model City
Homeownership Trust to the Model City Community Revitalization District Trust ("Trust"); and
WHEREAS, said Ordinances are now codified and are a part of the Code of the City of Miami,
Florida, as amended ("City Code");
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Section 12.5-30 of the City Code, entitled "Governing body -composition and
appointments," is amended in the following particulars:{1}

Sec. 12.5-30. Governing body -composition and appointments; terms of office and
vacancies; membership qualifications; procedures for appointment of members and;
oath; quorum and voting; meetings; attendance requirements; indemnification.
(a) Governing body -composition and appointments. The Trust shall consist of seven
members, one of whom shall be an elected appointed public advocate and six
individuals from professional disciplines and who shall be appointed by the Gity—
manager district 5 commissioner and confirmed by the city commission, as hereinafter
set forth.

(b) Terms of office and vacancies.
(1) The seven members Six shall serve be appointed by the city manager for a term
of four years. in the manner set forth in subsection (e)(1) and (2) of this section. The
district 5 commissioner or the city manager shall nominate an individual to fill a
vacancy due to the death, resignation or removal of any member of the Trust, which
appointment shall be confirmed by the city commission and shall serve only for the
remainder of the unexpired term. Nothing set forth herein shall prohibit any individual
from being reappointed.

(e) Procedure for appointment of members.
(1) Procedure for appointment of members. No appointment shall be made until
notice has been given at least 30 days prior to making the appointment in a newspaper
of general circulation in the city of the appointments to be made to the Trust. Persons
interest in and knowledge of the Model City area shall be solicited and encouraged to
serve from the public and professional or citizen organizations within the Model City
area. Qualifications of those to be considered as prospective appointees of the
advisory board shall be submitted. At least ten days prior to the making of any
appointment, the district 5 city commissioner shall cause to have available to the
public, and shall publicly make announcement of the fact, that the list of names thus
submitted, together with a short statement of the qualifications of each person, is
prepared and available for public inspection and consideration. In reaching decision on
appointments, the district 5 city commissioner shall give due consideration to the
names submitted.

Section 3. All Ordinances or parts of Ordinances that are inconsistent or in conflict withthe
provisions of this Ordinance are repealed.
Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective immediately upon its adoption and signature of
the Mayor.{2}

effective immediately upon override of the veto by the City Commission.
