Purpose of Item: Authorize the City Manager to execute a twenty-five year Air Space Agreement and Addendum to Airspace Agreement ("Agreement"), in substantially the attached form, with the State of Florida Department of Transportation ("FDOT"), for use of right-of-way property under interstate I-95 between N.W. 10th Street and N.W. 11th Street, Miami, Florida ("Athalie Range Amenity Area"), for public purpose and recreational use, with the City making certain capital improvements and maintaining the Athalie Range Amenity Area, subject to FDOT's approval of said improvements on the Athalie Range Amenity Area, and with other terms and conditions as more particularly set forth in the Agreement. Background Information: The City of Miami ("City") has negotiated a twenty-five year Airspace Agreement with FDOT and has requested authorization and approval from FDOT and the Federal Highway Administration (FHWA) to make certain capital improvements to right-of-wayh property known as the Athalie Range Amenity Area, located under interstate 1-95 between N.W. 10t Street and N.W. 1 Ith Street, Miami, Florida, for public purpose and recreational use. The City plans to use Safe Neighborhood Park Bonds funding for construction of the capital improvements. FDOT has stipulated that any changes or additions to the improvements will require additional prior approval in writing by the District Secretary for District Six, and FHWA. In the event FDOT requires the amenity area for permanent transportation purposes, the City will remove all amenity improvements and FDOT will reimburse the City the depreciated capital cost of the amenity improvements. The depreciated capital cost will be calculated on the basis of capital cost multiplied by a fraction being the age of the improvements as the numerator and the anticipated life of the improvements as the denominator. However, the anticipated life of the improvements will not exceed the term of the Agreement. Budget Impact Analysis NO Is this item related to revenue? NO Is this item an expenditure?
