HomeMy WebLinkAboutResolutionCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-00674 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A TWENTY-FIVE YEAR AIRSPACE AGREEMENT AND ADDENDUM TO AIRSPACE AGREEMENT (COLLECTIVELY "AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), FOR THE USE OF RIGHT-OF-WAY PROPERTY UNDER INTERSTATE 1-95 BETWEEN NORTHWEST 10TH STREET AND NORTHWEST 11TH STREET, MIAMI, FLORIDA, (ATHALIE RANGE AMENITY AREA"), FOR PUBLIC PURPOSE AND USE AS A RECREATIONAL AREA, WITH THE CITY OF MIAMI MAKING CERTAIN CAPITAL IMPROVEMENTS AND MAINTAINING SAID AMENITY AREA, SUBJECT TO FDOT'S APPROVAL OF SAID IMPROVEMENTS ON SAID AMENITY AREA, WITH ALL TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT. WHEREAS, the State of Florida Department of Transportation ("FDOT") is the owner of certain right-of-way property under Interstate 1-95 between Northwest 10th Street and Northwest 11th Street, Miami, Florida, ("Athalie Range Amenity Area"); and WHEREAS, the City of Miami ("City") is interested in making certain improvements to the Athalie Range Amenity Area using Safe Neighborhood Park Bonds and Homeland Defense/Neighborhood Improvement Bonds funding that will require prior authorization and approval from FDOT and the Federal Highway Administration; and WHEREAS, FDOT has agreed to enter into an Airspace Agreement and Addendum to the Airspace Agreement (collectively "Agreement") with the City for use of the Athalie Range Amenity Area for recreational purposes subject to prior approval of the improvements; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a twenty-five year Agreement, in substantially the attached form, with the FDOT, for the use of the Athalie Range Amenity Area, for public purpose and use as a recreation area, with the City making certain capital improvements and maintaining said amenity area, subject to FDOT's approval of said improvements on the amenity area, with all terms and conditions as more particularly set forth in said Agreement. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
