Dear Ms. Fernandez: This firm represents the Momingside Civic Association, Inc. (the "Appellant") in connection the above referenced requested Class IT Special Peimit. Pursuant to Miami Zoning Code, Article 20, please consider this our foil ial "request for review by the city commission". On or about July 15, 2004, the City issued a Class II special building petlit to construct a multi -story residential development at 5225 Biscayne Boulevard directly abutting the low density single family neighborhood of Morningside. On or about October 4, 2004, the City's Zoning Board denied Appellants' appeal of this decision and affirming the decision to issue the permit. Appellant alleges that the approval of this project and subsequent denial of the appeal is not based on substantial competent evidence, departs from the essential requirements of the law, fails to afford adequate due process, and is inconsistent with the City's adopted Comprehensive Plan and Land Development Regulations, particularly Section 1305. Enclosed with this request for review is a check in the amount of $500 required by your departmental rules and regulations.
