City of Miami City Hall 3500 Pan American Drive Legislation Miami, FL 33133 www.miamigov.com Resolution File Number: 11937 Final Action Date:5/12/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, RELEASING CERTAIN COVENANTS EFFECTING THE PROPERTY LOCATED AT 98 NW 27 STREET; MAKING FINDINGS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Resolution No. 05-0522, passed and adopted by the City of Miami City Commission on September 8, 2005, the City of Miami City Commission conveyed multiple city-owned parcels of land, including 98 NE 27 Street (the WHEREAS, in connection with the conveyance to Rafael, certain covenants were recorded at the Property including in that certain Quit-Claim Deed from the City to Rafael recorded May 10, 2006, in Official Records Book 24510, Page 3715, of the Public Records of Miami-Dade County, a Declaration of Restrictive Covenants recorded in Official Record Book 24510 at Page 3720 of the Public Records of Miami-Dade County, a Covenant Running with the Land Single Family covenant recorded in Official Record Book 25620 at Page 3046 of the Public Records of Miami-Dade County, and a Declaration of Restrictive Covenants for Affordable Home-Owner Developments recorded in Official Record Book 25879 at Page 2954 of the Public Records of Miami- WHEREAS, a single family home was constructed at the Property pursuant to Building Permit No. 07-5023273 and sold to an eligible purchaser on August 1, 2008; and WHEREAS, the Property has been conveyed multiple times since construction of the single family home which was demolished in 2015; and WHEREAS, the current growth and character of the Wynwood neighborhood makes the development of a single family home impractical; and WHEREAS, development of the Property at its best and highest use will result in maximizing the property taxes and impact fees paid to the City; and pursuant to Ordinance No. 12859 adopted October 12, 2006; and WHEREAS, In accordance with the Ordinance No. 13758, the Trust established the owner- Grant Program; and WHEREAS, it is in the best interest of the City to release the Covenants so that the Property may be developed in line with the character of the Wynwood neighborhood. NOW, THEREFORE, BE IT RESOLVED BY THE MIAMI CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The restrictions contained in that certain Quitclaim Deed recorded May 10, 2006, in Official Records Book 24510, Page 3715, of the Public Records of Miami-Dade County, the Declaration of Restrictive Covenants recorded in Official Record Book 24510 at Page 3720 of the Public Records of Miami-Dade County, Florida, the Covenant Running with the Land Single Family covenant recorded in Official Record Book 25620 at Page 3046 of the Public Records of Miami-Dade County, Florida and the Declaration of Restrictive Covenants for Affordable Home-Owner Developments recorded in Official Record Book 25879 at Page 2954 of the Public Records of Miami- affordable housing Grant Program from Bel Invest. Section 3. The City Manager or his designee is authorized to prepare any required releases for the above Covenants and record said releases in the Official Public Records of Miami-Dade County, Florida. Section 3. This Resolution shall be effective immediately upon its adoption. APPROVED AS TO FORM AND CORRECTNESS:
