This change in the future land use was accompanied by a change in zoning for the same properties. During the hearing on the 251", the City Commission approved the applicants request for a waiver to the 18-month waiting period for successive zoning applications. The applicant has applied to change the FLUM and zoning for the spring 2018 rezone cycle. Pursuant to City Code Sec. 62-8, applications to amend the comprehensive plan must be presented at public hearing no later than 45 days from the date of application within the month of March or September, depending on the cycle. January 25, 2018 Hearing: Covenant Modifications On January 25, 2018, the applicant's application for the rezone was modified on the floor at City Commission, requiring modification to his covenant. The covenant has not yet been recorded with the Miami -Dade County Clerk of Courts. The current application to modify the future land use designation and its companion rezone application are not ripe for hearing with the Planning Zoning and Appeals Board until the covenant to the rezoning approved by City Commission in January 2018 is recorded. Recommendation The Planning Department recommends continuing this item until May 2, 2018 to allow time necessary for signatures and recording with the Miami -Dade County Clerk. The purpose of this letter is to acknowledge that the land use and rezoning applications filed by the Applicant as part of the November 2017 cycle are being advertised for the March 26, 2018 hearing agenda before the Planning, Zoning and Appeals Board ("PZAB") with the intent to defer consideration of the applications to PZAB's regular meeting on May 2, 2018. The properties that are the subject of the current applications were recently approved by the City Commission for a land use amendment and a change of zoning classification (with a waiver of the generally applicable 18-month waiting period concerning successive zoning applications). The recent land use amendment, which included the acceptance of a voluntarily proffered covenant.
