A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY
A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED
PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S RECOMMENDATION AND EMERGENCY FINDING THAT IT IS
PRACTICABLE AND MOST ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY")
TO WAIVE COMPETITIVE BIDDING PROCEDURES, PURSUANT TO SECTION
18-89 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED;
ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING
THE FINDING OF THE CITY'S DEPARTMENT OF PUBLIC WORKS THAT CONDO
ELECTRIC MOTOR REPAIR CORP. IS THE MOST QUALIFIED FIRM TO
CONTINUE TO PROVIDE CITYWIDE STORM WATER PUMP STATION
MAINTENANCE SERVICES AND TO ADD SERVICES FOR NEWLY INSTALLED
GENERATORS FOR FOUR PUMP STATIONS CITYWIDE AND THE
NORTHWEST 14TH STREET PUMP STATION; AUTHORIZING THE CITY
MANAGER TO EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, FOR SAID SERVICES FOR THE CONTRACT PERIOD
COMMENCING SEPTEMBER 25, 2004 THROUGH SEPTEMBER 24, 2005, WITH
THE OPTION TO RENEW FOR TWO ADDITIONAL ONE-YEAR PERIODS, IN AN
ANNUAL AMOUNT NOT TO EXCEED $111,360; ALLOCATING FUNDS FROM
PUBLIC WORKS GENERAL FUND ACCOUNT NO. 001000.311003.6.340 FOR
FISCAL YEAR 2004-2005, IN THE AMOUNT NOT TO EXCEED $111,360, FOR
CONTRACT COSTS, PLUS $8,840 FOR ESTIMATED EXPENSES INCURRED BY
THE CITY, FOR TOTAL PROJECT COSTS IN THE AMOUNT NOT TO EXCEED
$120,200, WITH FUTURE FISCAL YEAR FUNDING FOR OPTIONAL PERIODS
SUBJECT TO BUDGETARY APPROVAL.
WHEREAS, pursuant to Resolution No. 03-1024, adopted September 25, 2003, the City
Commission accepted the competitive bid of Condo Electric Motor Repair Corp. ("Condo Electric") to
provide Citywide storm water pump station maintenance services for 2003-2004 and entered into a
maintenance services agreement ("Agreement") for said services with Condo Electric; and
WHEREAS, the City of Miami's ("City's") Department of Public Works has accepted responsibility
for the Northwest 14th Street Pump Station and has added four newly installed generators at existing
pump stations, and would like to add maintenance for those items to the 2004-2005 Agreement and
has determined that maintenance services of said Northwest 14th Street Pump Station and newly
installed generators at existing pump stations would increase the cost of the 2004-2005 Agreement for
both the service provider and the City; and
WHEREAS, the City's Department of Public Works has recommended and found that Condo
Electric is the most qualified firm to continue to provide said maintenance services; and
WHEREAS, the City's Department of Public Works has further found that as a result of the

enormous hurricane activity during the months of August and September and the need to prepare and
mobilize public works essential functions, the notice of extension of the Agreement with Condo Electric
was delayed by emergency circumstances; and
WHEREAS, the City Manager has approved the recommendation of the Department of Public
Works and has made a finding that pursuant to Section 18-89 of the Code of the City of Miami, Florida
("City Code"), as amended, a valid emergency situation exists and competitive negotiation methods
are not practicable or advantageous for obtaining said maintenance services, and has recommended
to the City Commission that the recommendations and findings be adopted and that competitive bid
methods be waived;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's recommendation and emergency finding that it is practicable and most advantageous for
the City to waive competitive bidding procedures, pursuant to Section 18-89 of the City Code, as
amended, is ratified, approved and confirmed and the recommendation of the City Manager approving
the finding of the City's Department of Public Works that Condo Electric is the most qualified firm to
continue to provide Citywide storm water pump station maintenance services and to add services for
newly installed generators for four existing pump stations Citywide and for the Northwest 14th Street
Pump Station is accepted.
Section 3. The City Manager is authorized{1} to execute an Agreement, in substantially the
attached form, for said services for the contract period commencing September 25, 2004 through
September 24, 2005, with the option to renew for two additional one-year periods, in an amount not to
exceed $111,360, with funds allocated from Public Works General Fund Account No.
001000.311003,6.340 for Fiscal Year 2004-2005, in the amount not to exceed $111,360, for contract
costs, plus $8,840 for estimated expenses incurred by the City, for total project costs in the amount not
to exceed $120,200, with future Fiscal Year funding for optional periods subject to budgetary approval.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.(2)

{1}The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission,
