City of Miami File ID: 15418 (Revision:) Printed On: 7/9/2024 City of Miami Legislation Ordinance File Number: 15418 Final Action Date: 1/25/2024 AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING CHAPTER 2/ARTICLE II/SECTION 2-33 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "ADMINISTRATION/MAYOR AND CITY COMMISSION/ORDER OF BUSINESS AND RULES OF PROCEDURE," TO LIMIT THE TIME FOR DEBATE AND DISCUSSION BY MEMBERS OF THE CITY COMMISSION; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Miami ("City") honors and respects the First amendment rights of the citizens and residents of the City to speak and participate at City Commission meetings; and WHEREAS, the Miami -Dade County Citizen's bill of rights affords the citizens and residents of the City the right to be heard, so far as the orderly conduct of public business permits; and WHEREAS, the Code of the City of Miami, Florida ("City Code") provides a time limit for members of the public to address the City Commission but does not provide a time limit on the amount of time that a City Commissioner may speak on an item; and WHEREAS, the City Commission finds it to be in the best interests of the citizens and residents of the City of Miami to amend its rules of procedure to provide for a more efficient means of conducting the City Commission meetings; NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 2, Article II, Section 2-33(c) of the City Code is amended in the following particulars:1 "CHAPTER 2 ADMINISTRATION ARTICLE II. MAYOR AND CITY COMMISSION Section 2-33. Order of business and rules of procedure. 1 Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. City of Miami File ID: 15418 (Revision:) Printed On: 7/9/2024 (c) After approval of the minutes of the previous meeting(s), all business that shall come before the city commission shall be taken up in the order as such items of business appear on the city commission agenda in accordance with the following provisions: (10) No member of the City Commission may speak until recognized by the presiding officer. Each member of the Commission shall be limited to five (5) minutes of debate or discussion on any item before the City Commission. The presiding officer may grant an additional five (5) minutes of speaking time. Thereafter, no additional speaking time will be granted unless approved by a majority of the City Commission. *11 Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4.
