Purpose of Item: An Ordinance amending Chapter 18, article III of the City Code, the "Procurement Ordinance," enacting a new section § 18-117 entitled "Economic Stimulus Awards & Agreements." The new section establishes measures to stimulate the local economy by creating a process to expedite the award of professional services agreements and construction contracts for certain capital improvement projects identified in Attachment A. The City Commission may add or delete projects by passage of resolutions. It authorizes the City Manager to advertise for, receive, review, reject, evaluate responses and award contracts for the listed projects. The Ordinance sunsets upon completion of the approved list of projects unless it is repealed earlier by the City Commission. The ordinance establishes procedures and limitations for award under the expedited process and authorizes the City Manager to execute the contracts, subject to budgetary approval. Background Information: The current nationwide economic crisis triggered by the decline in the housing market has substantially adversely impacted the City's businesses and labor market. The construction industry has been one of the hardest hit with unemployment up by approximately 15 percent in April 2008. The unemployment rate continues to increase in comparison to the same period last year. The rising rate of unemployment in the construction industry has contributed to the failure of local businesses and a foreclosure rate of 46% between January and September 2008. The City Manager finds it necessary, appropriate, and in the public's best interest to stimulate the local economy by expediting a list of projects, identified in Attachment A, to provide work to the community. The City Commission may, by passage of further resolutions, add or delete projects from the list of Economic Stimulus Projects. Director Chief City Manager Page 1 of 2 The program allows the City Manager to award contracts including professional services agreements and construction contracts, with contingency allowances of no more than ten (10) percent, without City Commission approval and to issue the Notice to Proceed. The authority applies for the listed projects where the value of the recommended award does not exceed the estimated cost of construction by more than 10%, at least three bids are received by responsive and responsible bidders, none of the bidders or proposers have timely filed a bid protest, and the award value has been reviewed by Budget; and further allows the City Manager to create evaluation committees whose composition will best expedite the evaluation process, eliminating the requirements of Section 18-543 (12) requiring that the majority of evaluation committee be from the public. The Program is to be executed in strict accordance with all applicable Florida Statutes and will always utilize competitive award methodologies to ensure fair competition while expediting local economic stimulus.
