Subject: A resolution vacating, discontinuing, and abandoning a strip of land and authorizing the City
Manager to execute a Quit -Claim Deed reverting ownership of said land to the abutting_ property owner.
Purpose of Item:
The purpose is for the City Commission to adopt a resolution vacating, discontinuing and abandoning
the East 2.70 feet of: the West 8.50 feet more or less of the South 1/2 of Lot 1 and the West 8.50 feet
more or less of the North 1/2 of Lot 2, Block 26, Waddell's Addition to the Town of Miami, according
to the plat thereof, as recorded in Plat Book B, at Page 53, of the Public Records of Miami -Dade
County, Florida, and authorizing and directing the City Manager to execute a Quit -Claim Deed
returning said 2.70 feet to the present adjacent property owner.
Background Information:
The adjacent property owner has brought to the City's attention that the deed of dedication recorded in
Official Records Book 14225, Page 3240, in 1989, causes the owner's existing building to encroach
into the dedicated area. The City has reviewed the property survey and the legal description of the said
deed of dedication and confirms the building encroachment.
The said building encroachment creates an encumbrance on the adjacent owner's property and it has
been determined that it would not be detrimental to the interest of the City or its citizens to relinquish
the aforesaid 2.70 feet , and not doing so would allow the encumbrance on the adjacent property to
perpetuate and diminish the value of the adjacent owner's property.
