A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1, IN
SUBSTANTIALLY THE ATTACHED FORM, INCREASING THE AMOUNT OF
FUNDING UNDER THE PROJECT CO-OPERATIVE AGREEMENT
("AGREEMENT") TO THE DADE HERITAGE TRUST, INC., IN AN AMOUNT NOT
TO EXCEED FIFTY-SIX THOUSAND DOLLARS ($56,000) FOR A NEW TOTAL
AMOUNT NOT TO EXCEED FOUR HUNDRED AND ELEVEN THOUSAND
DOLLARS ($411,000) AND FURTHER AMENDING THE AGREEMENT BY
INCORPORATING REQUIRED AUDIT LANGUAGE FOR PROJECTS FUNDED
WITH MIAMI-DADE COUNTY ("COUNTY") BUILDING BETTER COMMUNITIES
GENERAL OBLIGATION BOND PROGRAM FUNDING, AUTHORIZING THE
COUNTY AND THE INSPECTOR GENERAL TO ACCESS AND TO AUDIT DADE
HERITAGE TRUST'S PROJECT RECORDS; ALLOCATING FUNDS FROM
CAPITAL IMPROVEMENTS PROJECT NO. B-30532, FOR THE PROJECT
ENTITLED "OLD MIAMI HIGH RESTORATION."
WHEREAS, pursuant to Resolution No. 07-0355, adopted June 14, 2007, the City Commission
authorized a Project Co-operative Agreement (the "Agreement") between the City and the Dade
Heritage Trust, Inc. (the "Trust") in the not to exceed amount of Three Hundred and Fifty -Five
Thousand Dollars ($355,000) for the restoration of the historic First Miami High structure located at the
City owned Southside Park for the project entitled "Old Miami High, B-30532" (the "Project"); and
WHEREAS, Miami -Dade County (the "County") is providing Three Hundred Thousand Dollars
($300,000) for the Project to the City on a reimbursement basis from the County's Building Better
Communities General Obligation Bond Program ("GOB"), which the City is in turn providing on a
reimbursement basis to the Trust to undertake the Project, with the remaining Fifty -Five Thousand
Dollars ($55,000) of the City's current contribution provided to the Trust on a reimbursement basis
from the City's Homeland Defense/Neighborhood Improvement Bonds Program, Series I; and
WHEREAS, the Trust now requests from the City an increase in the amount of Fifty -Six Thousand
Dollars ($56,000) for funding for the Project under the Agreement not to exceed a new total amount of
Four Hundred and Eleven Thousand Dollars ($411,000); and
WHEREAS, the Trust is requesting the increase in funds to cover a shortfall due to increased
insurance costs, civil engineering drawing delays, and necessary change orders including: substitution
of a specified water fountain, additional equipment required by engineer post -contract, and
mechanical, electrical and plumbing plan revisions due to the conditions of the building; and
WHEREAS, the additional City funds are allocated for Capital Improvements Project No. B-30532;

WHEREAS, the County, as a financial contributor to the Project has required certain new language
regarding audits to be added to all GOB funded agreements;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are, adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. This City Manager is authorized{1} to execute Amendment No.1, in substantially the
attached form, increasing the amount of funding under the Agreement to the Dade Heritage Trust by
an amount not to exceed Fifty -Six Thousand Dollars ($56,000) for a new total amount not to exceed
Four Hundred and Eleven Thousand Dollars ($411,000), and further amending the Agreement by
incorporating required audit language for Projects funded by GOB funding Project, is authorized, with
funds allocated from Capital Improvements Project No. B-30532 for the project entitled "Old Miami
High Restoration."
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
