DALY COMPANY, FOR ADDITIONAL SERVICES REQUIRED IN ORDER TO OBTAIN LEADERSHIP IN ENERGY AND ENVIRONMENTAL DESIGN (LEED) CERTIFICATION, FOR THE MELREESE CLUBHOUSE AND RESTAURANT PROJECT, B-30566, IN THE AMOUNT NOT TO EXCEED $100,000, THEREBY INCREASING THE AMOUNT OF THE PSA FROM $495,399.74 TO $595,399.74; ALLOCATING FUNDS FROM CAPITAL PROJECT ACCOUNT B-30566. WHEREAS, on August 27, 2008, the City of Miami ("City") issued a Request for Qualifications ("RFQ") No. 06-07-030, for Architectural and Engineering Services for the design of the Melreese Clubhouse and Restaurant Project, B-30566 ("Project)"; and WHEREAS, in response, six (6) proposals were received on September 18, 2007, by the Department of Capital Improvements Program and an Evaluation Committee was then selected, approved by the City Manager, and met on December 11, 2007, to score and rank the top three firms based on their qualifications as stipulated in the submittals; and WHEREAS, the City through the action of the City Manager, selected a consultant in accordance with Section 287.005, Florida Statutes, (Consultant's Competitive Negotiation Act) and subsequently entered into an Agreement with LPo A Daly ('.nmpany� Consultant"), -the top--r-anked_firm onMarch 14, 2008; and WHEREAS, as part of the Mayor's initiative to promote Green Building practices, which will soon be integrated into the City's Building codes, the City has requested that Leadership in Energy and Environmental Design ("LEED") certification be acquired for this Project; and WHEREAS, the scope of work as stated in the Consultant's Professional Services Agreement ("PSA") does not include a provision for LEED certification which consists of; a feasibility study, modification to the design to achieve certification and the registration and certification process with the United States Green Building Council; and WHEREAS, the contract amount is based on a lump sum fee in the amount of $495,399.74, consisting of $460,399.74, for basic services, $20,000, for additional services and $15,000, for reimbursable expenses; and WHEREAS, it has been determined additional services are necessary for the LEED certification in City of Miami Page 1 of 2 Printed On: 12/1/2008 File Number. 08-01369 the amount of $100,000, increasing the contract from $495,399.74, for a total amount not to exceed $595,399.74; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1 } to execute Amendment No. 1, in substantially the attached form, to the PSA, with the Consultant, for additional services required in order to obtain LEED Certification, for the Project, in the amount not to exceed $100,000, thereby increasing the amount of the PSA from $495,399.74 to $595,399.74, with funds allocated from Capital Project Account B-30566. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} The authorization herein is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
