Dear Ms. Fernandez:
On behalf of the owner Stavel Three, LLC, Inc., we are requesting an amendment pursuant
to paragraph IV of the attached Declaration of Restrictions dated November 16, 2004 and recorded
in the Public Records of Miami Dade County in Official Records Book 22923 at Page 3035 (the
"Declaration"). Said Declaration was amended last year by the City Commission per Resolution
No. 07-0655 and the Amended Declaration dated October 23, 2007. Due to changing market
conditions over the past few years, the original Declaration has been modified by the City
Commission and another modification is being requested.
We are seeking to revise the prior dated plans of April 27, 2007 prepared by Behar Font &
Partners and change the project from an office building with ground floor retail and 9 residential
units to a hotel and a residential building with ground floor retail. We have included the proposed
plans prepared by Behar Font & Partners dated October 31, 2008.
We are requesting approval by the City of Miami Commission to modify and amend the
Declaration of Restrictions by replacing the April 27, 2007 architectural plans with the October,
2008 plans attached hereto.
Enclosed please find a copy of the original Declaration of Restrictions, the Amendment to
Declaration of Restrictions, Resolution No. 07-0655, the proposed Second Amendment to
Declaration of Restrictions, and the proposed new architectural plans dated October 2008.
