HomeMy WebLinkAboutR-24-0245City of Miami Resolution R-24-0245 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 16231 Final Action Date: 6/27/2024 A RESOLUTION OF THE MIAMI CITY COMMISSION WAIVING THE TWO (2) WEEK TEMPORARY EVENT LIMITATION PER YEAR FOR THE PRIVATE PROPERTY LOCATED AT 1361 NORTHEAST 1 AVENUE, MIAMI, FLORIDA PURSUANT TO CHAPTER 62/ARTICLE XIII/DIVISION 1/SECTION 62- 521(B)(4) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "PLANNING AND ZONING/PLANNING AND ZONING APPROVAL FOR TEMPORARY USES AND OCCUPANCIES; PERMIT REQUIRED/TEMPORARY EVENT PERMITS/TEMPORARY EVENTS IN GENERAL," TO ALLOW FOR PADEL X, PADEL BALL EVENTS TO CONTINUE FOR AN ADDITIONAL SIX (6) MONTHS AFTER AUGUST 26, 2024. SPONSOR(S): Commissioner Damian Pardo WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended ("City Code"), titled "Temporary Events in General," temporary events on private property are limited to no more than two (2) events per year per property for a maximum of two (2) weeks per permit; and WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the limitation on the number of events can be waived upon affirmative vote of the City Commission; and WHEREAS, padel ball is a fast rising sport, attracting people of all ages to play; and WHEREAS, Padel X has leased the private property located at 1361 Northeast 1st Avenue, Miami, Florida ("Event Site") in order to hold padel ball events and competitions; and WHEREAS, Padel X has created pop-up courts for both residents and visitors to enjoy this new sport; and WHEREAS, the Event has already processed several temporary event permits; and WHEREAS, the Event wishes to continue to operate past the initial two (2) events for only two (2) weeks as provided in the City Code; and WHEREAS, the Event has continued to operate as provided for in Resolution No. 23- 0555 commencing on February 26 2024 and wishes to continue to operate, thereby requiring another wavier starting August 26, 2024 for an additional six (6) months; and WHEREAS, the Event at the Event Site does require permits to be issued by the City of Miami ("City") to ensure life -safety and quality of life issues and appropriate conditions may be imposed on each permit as well as compliance with all other Sections of the City Code; and WHEREAS, the Event at the Event Site will be beneficial to the City's residents and visitors; City of Miami Page 1 of 2 File ID: 16231 (Revision: A) Printed On: 7/5/2024 File ID: 16231 Enactment Number: R-24-0245 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Temporary Events in General," the two (2) temporary events per year for two (2) weeks limitation on private property is hereby waived for the Event at the Event Site that has commenced for another additional period of six (6) months after August 26, 2024. Section 3. This Resolution does not waive any other requirements of the City Code, including but not limited to, noise restrictions, applicable fees, inspections, and permits. Section 4. This Resolution shall become effective immediately upon its adoption.
