A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING GRANT FUNDS, IN THE AMOUNT NOT TO EXCEED $1,000,000,
CONSISTING OF A DRAINAGE IMPROVEMENT GRANT FROM THE
DEPARTMENT OF ENVIRONMENTAL PROTECTION, WITH THE AMOUNT OF
$500,000, BEING APPROPRIATED TO FUND THE FAIRLAWN STORM SEWER
IMPROVEMENTS PROJECT - PHASE III, B-50704, AND THE REMAINING
AMOUNT OF $500,000, BEING APPROPRIATED TO FUND THE SAN MARCO
AND BISCAYNE ISLANDS DRAINAGE IMPROVEMENTS, B-30588;
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, IN ORDER TO IMPLEMENT THE
ACCEPTANCE OF AND ADMINISTRATION OF SAID GRANT; FURTHER
IDENTIFYING THE CITY OF MIAMI'S REQUIRED MATCHING FUNDS, FROM
HOMELAND DEFENSE AND STREET BOND FUNDS FOR THE FAIRLAWN
PROJECT, FROM CAPITAL IMPROVEMENT PROGRAM ("CIP") PROJECT NO.
B-50704, AND MATCHING STREETS BOND FUNDS FOR THE SAN MARCO
PROJECT, FROM CIP PROJECT NO. B-30588.
WHEREAS, the City of Miami ("City") has established capital improvement projects to improve the
drainage in various communities throughout the City; and
WHEREAS, said projects have been incorporated into the City's Capital Improvement Program
("CIP") and Multi -year Plan; and
WHEREAS, the City applied for and received a $1,000,000 grant from the Florida Department of
Environmental Protection ("DEP") for drainage improvement projects; and
WHEREAS, CIP wishes to utilize the amount of $500,000 of the award for the Fairlawn Storm
Sewer Improvements Project -Phase III, B-50704, and the amount of $500,000 for the San Marco and
Biscayne Islands Drainage Improvements Project, B-30588; and
WHEREAS, the grant award requires matching funds from the City, which have been identified;
and
WHEREAS, the DEP award must be formally accepted and appropriated by the City; and
WHEREAS, this item authorizes the City Manager to execute the necessary documents to accept
and administer the grant; and
WHEREAS, the funds will be appropriated by a separate resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. Grant funds, in the amount not to exceed $1,000,000, consisting of a Drainage
Improvement Grant from DEP, with the amount of $500,000, being appropriated to fund the Fairlawn
Storm Sewer Improvements Project - Phase III, B-50704, and the remaining amount of $500,000,
being appropriated to fund the San Marco and Biscayne Islands Drainage Improvements, B-30588,
are accepted.
Section 3. The City Manager is authorized{1} to execute an Agreement, in substantially the
attached form, in order to implement the acceptance of and administration of said grant.
Section 4. Funds, for the City's required matching funds, have been identified from Homeland
Defense and Street Bond funds for the Fairlawn Project, from CIP Project No. B-50704, and matching
Streets Bond funds for the San Marco Project, from CIP Project No. B-30588.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
