HomeMy WebLinkAboutPre Legislation 2City of Miami Certified Copy City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00352 Enactment Number: R-07-0137 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), CONVEYING, WITH PARCEL REVERTER PROVISIONS, FIVE (5) CITY OF MIAMI OWNED PARCELS OF LAND, AS LEGALLY DESCRIBED IN ATTACHMENT "A", ATTACHED AND INCORPORATED, TO PARKVIEW GARDENS, L.P., FOR THE DEVELOPMENT OF AFFORDABLE HOUSING; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 06-0164, adopted March 9, 2006, the City Commission approved the conveyance of five (5) City of Miami ("City") owned parcels of land, as legally described in "Attachment A," attached and incorporated, to Carlisle Group VI, Ltd., for the development of affordable housing; and WHEREAS, the purchase sale agreement expired on December 31, 2006; and WHEREAS, the City is the current owner of the five (5) parcels of land, as legally described in "Attachment A," attached and incorporated; and WHEREAS, one of the five (5) parcels, located at 1421 Northwest 61 Street, Miami, Florida, is zoned for Parks and Recreation; and WHEREAS, the parcel located at 1405 Northwest 61 Street, Miami, Florida, was originally purchased for Parks and Recreation but it is not zoned for it; and WHEREAS, the Administration is recommending to convey, with parcel reverter provisions, the five (5) City -owned parcels of land, to Parkview Gardens, LP, for the development of affordable housing; and WHEREAS, the City has identified $56,000, of project related costs that will be assigned and charged to said project; and WHEREAS, Parkview Gardens, LP, will have twelve (12) months from the date of land conveyance to start construction; and WHEREAS, Parkview Gardens, LP, will have thirty-six (36) months from the date of land conveyance to complete construction; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to convey, with parcel reverter provisions, five (5) City of Miami Page 1 of 2 R-07-0137 File Number: 07-00352 Enactment Number: R-07-0137 City -owned parcels of land, as legally described in "Attachment A," attached and incorporated, to Parkview Gardens, LP, for the development of affordable housing. Section 3. The City Manager is further authorized{1} to execute the necessary documents for said purpose. Section 4. September 09, 2008 Date Certified {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
