Pan P e n s n D.Psve EL 331:33 ,kroAraJT!ia; gcv.etcrn File Number: 08-90697v Final Action Oatc: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DENYING THE APPEAL, AFFIRMING THE DECISION OF THE ZONING BOARD, THEREBY DENYING A VARIANCE FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 19, SECTION 1901; ARTICLE 6, SECTION 614.3.5.3.1, TO ALLOW A REAR SETBACK OF 2'7" (10'0" REQUIRED) FOR AN EXISTING SINGLE-FAMILY RESIDENCE, FOR THE PROPERTY LOCATED AT APPROXIMATELY 1727 SOUTHWEST 4TH STREET, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board, at its meeting on July 14, 2008, Item No.10, made a motion to approve, which failed. constituting a DENIAL of the variance, following an advertised public hearing, thereby adopting Resolution No, ZB-08-063 by a vote of three to four (3-4), for the Variance as set forth; and WHEREAS, the applicant has appealed the decision of the Zoning Board; and WHEREAS, the City Commission after careful consideration of this matter finds that the stated grounds for the appeal and the facts presented in support thereof do not justify reversing the decision of the Zoning Board; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA_ Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission denies the appeal, and affirms the decision of the Zoning Board, thereby denying the variance from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 19, Section 1901, entitled Variance defined; limitations; Article 6, Section 614.3.5.3.1, entitled Minimum Yards, to allow a rear setback of 27" (10°0" required) for an existing single-family residence, for the property located at approximately 1727 Southwest 4th Street, Miami, Florida, legally described in attached "Exhibit A." Section 3.
