District Impacted: 5 Type: J Resolution U Ordinance U Emergency Ordinance U Discussion Item ❑ Other Subject: Purchase and Sale Agreement for the acquisition of properties located at 551 NW 71 Street, 7142 and 7148 NW 5 Court, Miami, Florida " Purpose of Item: A Resolution of the Miami City Commission, with attachment(s), authorizing the City Manager to execute a Purchase and Sale Agreement ("Agreement") for the acquisition of the properties located at 551 NW 71 Street, 7142 and 7148 NW 5 Court, Miami, Florida, ("Property"), containing an aggregate area of 35,643 square feet more or less, as legally described in the Purchase and Sale Agreement between the City of Miami and David and Walter R. Miller, attached hereto and made a part hereof, for a total purchase price of One Million Two Hundred Seventy Seven Thousand Five Hundred ($1,277,500) Dollars; authorizing the City Manager to execute any necessary documents, in a form acceptable to the City Attorney, which are necessary to effectuate said acquisition. This Resolution further establishes an award and allocates funds in the total amount not to exceed One Million Three Hundred Twenty Four Thousand ($1,324,000) Dollars from the Public Works General Fund to a capital account, Project No. B-3055I, entitled Public Works Maintenance Yard, to cover the cost of said acquisition inclusive of the cost of survey, environmental report, title insurance and related closing costs associated with said acquisition, in accordance with the terms and conditions of the agreement, which terms may be amended by the City Manager, as may be necessary in order to meet the best interest of the City. Director City Manager Paee 1 of 3 Subject: Purchase and Sale Agreement for the acquisition of properties located at 551 NW 71 Street, 7142 and 7148 NW 5 Court Miami Florida Background information: The Fiscal Year 2009 budget allocation for Public Works will allow the department to proceed with this purchase. However, certain eligible, right-of-way maintenance activities as permissible in Chapter 54, Section 54-3, entitled, "Streets and Sidewalks," will be funded via the Lane Closure Special Revenue Fund. The external area that Public Works Operations occupies is quite small and is not adequate to accommodate the 85,plus pieces of equipment (includes equipment and trucks). Entry and exit out of the yard is difficult due to maneuvering constraints at the gate. It currently takes over an hour and fifteen minutes to maneuver equipment in and out before full deployment is completed in the mornings. This is the same case in the afternoon since equipment needs to be wedged in the storage area to allow every piece of equipment to fit. This severely limits service hours, This space constriction is not only a safety hazard for the staff but it also adds additional traffic to the already overburdened NW 13 Avenue and NW 20 Street. This new facility would be used to safely store the City's equipment and stock pile materials. The existing structure, will allow field office staff to have offices and meeting areas to safely conduct day to day operations while the rest of the building will allow the labor staff to have adequate restrooms, lockers to protect their personal property, storage for safety equipment, and training rooms. In 2005, the Public Works Department engaged an independent consulting firm to prepare a Maintenance Study. A study of this kind had never been conducted in the department's history. In its findings and recommendations, the firm recommended that a dedicated location/site be acquired to house the maintenance yard. They also recommended a meeting/training area for use during days when weather prohibits outside work as well as an area to place lockers assigned to crew members. These lockers would allow crew members to store personal belongings as well as personal safety equipment. In order to adequately accommodate the Operations employees, numerous pieces of heavy -equipment and stockpilesof materials -to -perform maintenance of -the public -rights -of- way, a maintenance yard of 3.0 acres is required. The Public Works and Public Facilities Departments have been aggressively working with various sellers for the past two years to acquire a facility for Public Works that would be adequate to accorrunodate the staff and fleet for a large City such as our own. The City has been presented with an opportunity to purchase properties located at 551 NW 71 Street, 7142 and 7148 NW 5 Court Miami, Florida for use as its Operations yard. The negotiated amount is $1,277,500, which is the average fair market value based upon two appraisals procured by the City. This property, which includes a building, was originally listed for $2.4 million. Due to the decline in the real estate market, the price has now been reduced to $1,277,500. Although these properties total 0.818 acres, we have the unique position that they are adjacent to 1-95. Since I-95 is adjacent to these properties, the Florida Department of Transportation (FDOT) has agreed to lease the area under I-95 for one dollar per year, adding an additional 2.203 acres to the overall yard. This would give the City of Miami Public Works Operations a 3.02 acre area to properly house its maintenance yard. The Public Works Department and Public Facilities agree that this is a more than fair and acceptable price for these properties. Pate 2 of 3 Subject: Purchase and Sale Agreement for the acquisition of properties located at 551 NW 71 Street, 7142 and 7148 NW 5 Court, Miami, Florida Background Information Cont'd: Currently, the Public Works Operations Division operates out of three portable trailers which were leased seven years ago (one of which was donated by FEMA) in a small area that is shared with GSA, Parks and Solid Waste on NW 201r' Street. The existing trailers which make up the field offices are inadequate and deteriorated. There are an insufficient number of bathrooms in the trailers available to the yard staff and crews (two (2) bathrooms for -over-65 employees). - Since the trailers are adjacent to NW 20 Street, they have been broken into and vandalized on several occasions. Additionally, with the opening of the mini -dump two years ago, the sanitary conditions have declined. There has been an increase in roaches, vermin, and odor inside the trailers. Parking for the staff was reduced by over 20 spots. Furthermore, in order for users and/or residents to get to the dump, they must drive through the Operations yard to get to the dump site. Employee complaints related to damage of their personal vehicles from debris being carried into the dump has increased. The Public Works Department was declared a first responder department by the Department of Homeland Security. Public Works personnel and equipment are responsible to protect, restore, and maintain critical infrastructure and services during a mass incident. The equipment and the crews are in portable trailers and the equipment is not protected from the elements. Should a natural disaster or mass incident occur, response could be jeopardized due to the existing housing conditions. Pape 3nf3
