A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE PIGGYBACK OF VARIOUS CONTRACTS EXISTING UNDER
THE HOUSTON-GALVESTON AREA COUNCIL ("H-GAC") COOPERATIVE
PURCHASING PROGRAM AND OTHER CONTRACTS AS MAY BECOME
AVAILABLE UNDER THE PROGRAM ("H-GACBUY"), ON AN AS -NEEDED
CONTRACTUAL BASIS; FURTHER ACCEPTING THE EXECUTED INTERLOCAL
AGREEMENT BETWEEN THE CITY OF MIAMI ("CITY") AND H-GAC, IN
SUBSTANTIALLY THE ATTACHED FORM; AUTHORIZING THE CITY'S
PARTICIPATION IN THE H-GACBUY PROGRAM; ALLOCATING FUNDS FROM
THE VARIOUS SOURCES OF FUNDS FROM THE USER DEPARTMENT(S) AT
THE TIME OF NEED.
WHEREAS, the Houston -Galveston Area Council ("H-GAC") is a regional council of
governments operating under the laws of the State of Texas and governed by a board comprised of 35
elected officials from the 13 county regions; and
WHEREAS, the H-GAC Board awards all contracts, which can then be made available to local
governments nationwide through Houston -Galveston Area Council Cooperative Purchasing Program
("HGACBuy"); and
WHEREAS, H-GACBuy is a self -funded "Enterprise Fund" government agency, self -supported
through an administrative fee assessed to the contractor, with no annual membership dues required of
its users; and
WHEREAS, the H-GACBuy Program is over 30 years old and specializes in high ticket, capital
intensive products and services that require technical, detailed specifications and extensive
professional skills to evaluate bid responses; and
WHEREAS, all products and services offered through H-GACBuy have been awarded by virtue
of a public competitive process; and
WHEREAS, in the past, there has been a need for the City of Miami ("City") Police Department
to piggyback from the H-GAC Contract for Emergency Equipment and Supplies for the purchase of
Speed Measuring Devices, requiring the execution of an Interlocal Agreement between the City and
H-GAC in order to access such contract; and
WHEREAS, it is in the City's best interest to maintain access to this program and continue to
take advantage of its volume purchasing and discounts;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA;

Section 1. The recitals and findings contained in the Preamble to this Resolution are
lopted by reference and incorporated as if fully set forth in this Section.
Section 2. The piggyback of various contracts existing under the H-GACBuy and other
contracts as may become available under the program, on an as -needed contractual basis, is
authorized, with funds allocated from the various sources of funds from the user department(s) at the
time of need.
Section 3. The executed Interlocal Agreement between the City and H-GAC, in substantially
the attached form, authorizing the City's participation in the H-GACBuy Program, is accepted.
Section 4. This Resolution shall become effective immediately upon its adoption and the
signature of the Mayor. {1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten
calendar days from the date it was passed and adopted. If the Mayor vetoes this
Resolution, it shall become effective immediately upon override of the veto by the City
Commission.
