HomeMy WebLinkAboutR-08-0577City of Miami Legislation Resolution: R-08-0577 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-01172 Final Action Date: 10/16/2008 A RESOLUTION OF THE MIAMI CITY COMMISSION CLASSIFYING ONE (1) REAR -LOADER GARBAGE TRUCK #20003 (1994 MACK, MODEL #DM88S), VEHICLE IDENTIFICATION NUMBER (VIN) #1 M2B218C1 RM003126, AS CATEGORY "A" SURPLUS STOCK, AND DONATING SAID TRUCK TO THE HAITIAN AMERICAN CITIZENSHIP AND VOTER EDUCATION CENTER INC., A 501 (C) (3) NON-PROFIT ORGANIZATION, UPON THE EXECUTION OF THE APPROPRIATE RELEASE DOCUMENTS; AUTHORIZING DYNAMIC POWER HYDRAULIC, INC. TO REPAIR SAID TRUCK, PRIOR TO SAID DONATION, IN THE AMOUNT NOT TO EXCEED $20,000, UTILIZING MIAMI-DADE COUNTY CONTRACT NO. 5380-6/14; ALLOCATING FUNDS FROM THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION, ACCOUNT CODE NO. 05001.247000.546000.0000.00000. WHEREAS, the Department of Solid Waste decommissioned one (1) Rear -Loader Garbage Truck #200033 (1994 Mack, Model #DM88S) , Vehicle Identification Number (VIN) #1 M2B218C1 RM003126; and WHEREAS, the Chief Procurement Officer has declared the truck as surplus; and WHEREAS, pursuant to the Section 18-82 of the Code of the City of Miami, Florida, as amended, a surplus declared as Category "A" stock shall be available for disposition as the City's contribution or the City's commitment in support of a particular public purpose, which may include community, civic or social service programs as may be authorized by the City Commission; and WHEREAS, not -for -profit organizations which provide a public purpose shall be offered first consideration as recipients for the disposition of Category "A" surplus stock; and WHEREAS, the Haitian American Citizenship and Voter Education Center, Inc., a 501 (c) (3) non-profit organization is an exclusively charitable, scientific, literary and educational organization with goals to serve Haitians and to educate the need and value of becoming United States citizens, recognize that voting is an unalienable constitutional right guaranteed to all citizens, and to assist and prepare the required citizenship applications on behalf of applicants; and WHEREAS, this organization working in the Haitian community is confronted with the pain and suffering being endured by families not only in the United States, but in Haiti, due to the devastation in the past month caused by four consecutive storms, including two hurricanes, Fay, Gustav, Hanna, and Ike; and WHEREAS, these storms destroyed the already fragile infrastructure of this Caribbean nation; and City of Miami Page 1 of 2 File Id: 08-01172 (Version: 1) Printed On: 5/16/2017 File Number: 08-01172 Enactment Number: R-08-0577 WHEREAS, Haiti is a nation of about 9 million people who are suffering, an estimated 300,000 children have been affected, and approximately 500 to 600 people have died; and WHEREAS, the City Commission via this resolution wishes to donate said truck to the Haitian American Citizenship and Voter Education Center, Inc., upon the execution of the appropriate release documents, and in turn, said organization will donate the truck to Port Au Prince, Haiti, to assist with the debris removal process caused by the various storms; and WHEREAS, before said donation takes place, the truck will be repaired by Dynamic Power Hydraulic, Inc. utilizing Miami -Dade County Contract No. 5380-6/14 for leach arts and repairs, in an amount not to exceed $20,000, with funds allocated from the Department of General Services Administration, Account No. 05001.247000.546000.0000.00000; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. One (1) Rear -Loader Garbage Truck #200033 (1994 Mack, Model #DM88S), Vehicle Identification Number (VIN) #1 M2B218C1 RM003126, is classified as Category "A" surplus stock. Section 3. The truck as previously described, is donated to the Haitian American Citizenship and Voter Education Center, Inc., a 501 (c) (3) non-profit organization, upon the execution of the appropriate release form. Section 4. Dynamic Power Hydraulic, Inc., is authorized to repair said truck, prior to said donation, in the amount not to exceed $20,000, utilizing Miami -Dade County Contract No. 5380-6/14, with funds allocated from the Department of General Services Administration, Account No. 05001.247000.546000.0000.00000. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
