HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall_ 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-01128 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A DONATION IN THE FORM OF IMPROVEMENTS TO A VESSEL FINGER PIER LOCATED AT MIAMARINA, 401 BISCAYNE BOULEVARD, MIAMI, FLORIDA, CONSISTING OF HIRING A MARINE CONTRACTOR TO DEMOLISH AN EXISTING FINGER PIER LOCATED AT PIER 5 SLIP 1-2 AT MIAMARINA, AND REPLACING IT WITH A NEW FINGER PIER, AS DEPICTED IN "EXHIBIT A," ATTACHED AND INCORPORATED, WITH AN ESTIMATED VALUE IN THE AMOUNT OF $45,000, FROM SIGHTSEEING TOURS MANAGEMENT, INC.; SAID ACCEPTANCE IS SUBJECT TO SIGHTSEEING TOURS MANAGEMENT, INC. EXECUTING THE IMPROVEMENTS AND INDEMNIFICATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM; FURTHER AUTHORIZING THE CITY MANAGER EXECUTE THE NECESSARY DOCUMENTS TO IMPLEMENT ACCEPTANCE OF SAID DONATION. WHEREAS, the City of Miami ("City") is the owner of real property located at 401 Biscayne Boulevard, Miami, Florida, commonly known as Miamarina ("Miamarina") and manages and operates Miamarina as a municipal marina open to the public; and WHEREAS, Sightseeing Tours Management, Inc. ("Licensee") owns and operates several commercial sightseeing vessels at Miamarina and is a licensee in good standing with the City; and WHEREAS, updated United States Coast Guard regulations pertaining to vessel stability and the safety of sightseeing vessel passengers has necessitated the replacement of certain existing Licensee commercial vessels with newer, wider vessels; and WHEREAS, the Licensee has requested authorization from the City to hire a marine contractor to demolish an existing finger pier at Miamarina utilized by Licensee as part of its operations and replace said finger pier with a new, wider finger pier of a similar construction at no cost or expense to the City; and WHEREAS, the estimated cost of the demolition work and requested improvements is $45,000; and WHEREAS, the improvements will also better accommodate the many passengers that utilize the Licensee's commercial sightseeing vessels with disabilities; and WHEREAS, pursuant to Section 18-115 of the Code of the City of Miami, Florida, as amended, entitled "Acceptance of donations," donations in access of $25,000, require approval of the Miami City Commission; City of Miami Page 1 of 2 Printed On: 10/1/2008 File Number 08-01128 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept a donation in the form of improvements to a vessel finger pier at Miamarina, which consists of hiring a marine contractor to demolish and replace a finger pier located at Pier 5 Slip 1-2, as depicted in "Exhibit A," attached and incorporated, with an estimated value in the amount of $45,000, subject to the Licensee executing the Improvements and Indemnification Agreement, in substantially the attached form. Section 3. The City Manager is further authorized{1} to execute the necessary documents to implement the acceptance of said donation. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JULIE O. BRU CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
