A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S);
APPROVING THE AMOUNT OF $1,012,863, AS THE TOTAL ANNUAL BUDGET
FOR THE CIVILIAN INVESTIGATIVE PANEL, FOR THE FISCAL YEAR
COMMENCING OCTOBER 1, 2008 AND ENDING SEPTEMBER 30, 2009.
WHEREAS, the City of Miami ("City") approved and adopted the Civilian Investigative Panel
("CIP") pursuant to Ordinance No. 12188; and
WHEREAS, the CIP serves as an independent citizens' oversight with authority to conduct
Investigations related to allegations of police misconduct, reviews policies of the Department of Police
and is empowered to issue subpoenas for police related investigations; and
WHEREAS, Section 11.5-10 of the Code of the City of Miami, Florida, as amended, requires that a
budget, pertaining to the management, operations, maintenance and capital expenditures for the CIP,
be approved by the City Commission; and
WHEREAS, the CIP adopted the attached annual plan and budget for the Fiscal Year commencing
October 1, 2008, and ending September 30, 2009;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated
as if fully set forth in this Section.
Section 2. The proposed amount of $1,012,863, as total annual budget for the CIP, for the Fiscal
Year commencing October 1, 2008, and ending September 30, 2009, is approved.
Section 3. This Resolution shall be effective immediately upon its adoption and signature of the
Mayor. (1

from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become

Please be advised that the Civilian Investigative Panel (CIP) took action at its meeting of
September 16, 2008, via Resolution No. CIP No. R-08-002, to submit a revised FY 2008-
2009 budget proposal for City Commission consideration. Promptly following City
Commission action on the Item BH-17, on September 25, 2008, the CIP will convene
meeting(s) to determine line item allocations of the funding approved by the
Commission.
Attached therefore are: Resolution # CIP No. R-08-002 and corresponding Legislation as
substitutes for the previously submitted Resolution and Legislation currently included as
attachments for the said agenda item.
Resolution No. CIP R-08-002 reflects the following changes:
1. A total proposed budget of $1,012,863 instead of $1,141,880 was inserted in
the Title of the Resolution to read:
"A RESOLUTION OF THE CITY OF MIAMI CIVILIAN INVESTIGATIVE
PANEL WITH ATTACHMENT(S) APPROVING FOR SUBMISSION TO THE
MAYOR AND CITY COMMISSION A PROPOSED BUDGET IN THE
AMOUNT OF S1,012,863 FOR FISCAL YEAR 2008-2009" instead of
reading: "A RESOLUTION OF THE CITY OF MIAMI CIVILIAN
INVESTIGATIVE PANEL WITH ATTACHMENT(S) APPROVING FOR
SUBMISSION TO THE MAYOR AND CITY COMMISSION A PROPOSED
BUDGET IN THE AMOUNT OF S1,141, 880 FOR FISCAL YEAR 2008-
2009.''
2. The word "approved" instead of "reviewed the attached" and the amount of
$1,012,863 instead of $1,141,880 were inserted in the Preamble, on page 1 of
the Resolution to read:

The followingcorrection was made to the proposed Legislation:
1. The amount of S1,012,863 instead of $1,141,880 was inserted in the Title of
the Legislation to read:
"A DISCUSSION OF THE MIAMI CITY COMMISSION REGARDNG A
RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), APPROVING THE PROPOSED BUDGET FOR THE
CIVILIAN INVESTIGATIVE PANEL, IN THE AMOUNT OF $1, 012, 863, FOR
THE FISCAL YEAR COMMENCING OCTOBER 1, 2008 AND ENDING
SEPTEMBER 30, 2009" instead of reading, "A DISCUSSION OF THE
ML4MI CITY COMMISSION REGARDING A RESOLUTION OF THE

SUBMISSION TO THE MAYOR AND CITY
COMMISSION A PROPOSED BUDGET IN
THE AMOUNT OF $1,012.863 FOR FISCAL
YEAR 2008-2009.
Whereas the City of Miami Civilian Investigative Panel (CIP) pursuant to
Ordinance No. 12188 Sec. 11.5-35 is required to submit to the City Commission a
Budget request pertaining to its functions; and
Whereas the CIP has met and approved a budget in the amount of $1,012.863 for
Fiscal Year commencing October 1, 2008, and ending September 30, 2009; and
NOW THEREFORE, BE IT RESOLVED BY THE CIVILIAN INVESTIGATIVE
PANEL THAT:
1. The proposed CIP Annual Budget Proposal for Fiscal Year
commencing October 1, 2008, and ending September 30, 2009, is approved by the
Panel on this 16th day of September 2008.
2. This Resolution shall become effective immediately upon its adoption
and signature by the Chairperson.
