WHEREAS, the City of Miami ("City") approved and adopted the Civilian Investigative Panel ("CIP") pursuant to Ordinance No. 12188; and WHEREAS, the CIP serves as an independent citizens' oversight with authority to conduct Investigations related to allegations of police misconduct, reviews policies of the Department of Police and is empowered to issue subpoenas for police related investigations; and WHEREAS, Section 11.5-10 of the Code of the City of Miami, Florida, as amended, requires that a budget, pertaining to the management, operations, maintenance and capital expenditures for the CIP, be approved by the City Commission; and WHEREAS, the CIP adopted the attached annual plan and budget for the Fiscal Year commencing October 1, 2008, and ending September 30, 2009; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated as if fully set forth in this Section. Section 2. The proposed amount of $1,012,863, as total annual budget for the CIP, for the Fiscal Year commencing October 1, 2008, and ending September 30, 2009, is approved. Section 3. Promptly following City Commission action on the Item BH-17, on September 25, 2008, the CIP will convene meeting(s) to determine line item allocations of the funding approved by the Commission. Attached therefore are: Resolution # CIP No. R-08-002 and corresponding Legislation as substitutes for the previously submitted Resolution and Legislation currently included as attachments for the said agenda item. Resolution No. CIP R-08-002 reflects the following changes: 1. A total proposed budget of $1,012,863 instead of $1,141,880 was inserted in the Title of the Resolution to read: "A RESOLUTION OF THE CITY OF MIAMI CIVILIAN INVESTIGATIVE PANEL WITH ATTACHMENT(S) APPROVING FOR SUBMISSION TO THE MAYOR AND CITY COMMISSION A PROPOSED BUDGET IN THE AMOUNT OF S1,012,863 FOR FISCAL YEAR 2008-2009" instead of reading: "A RESOLUTION OF THE CITY OF MIAMI CIVILIAN INVESTIGATIVE PANEL WITH ATTACHMENT(S) APPROVING FOR SUBMISSION TO THE MAYOR AND CITY COMMISSION A PROPOSED BUDGET IN THE AMOUNT OF S1,141, 880 FOR FISCAL YEAR 2008- 2009.'' 2. Whereas the City of Miami Civilian Investigative Panel (CIP) pursuant to Ordinance No. 12188 Sec. 11.5-35 is required to submit to the City Commission a Budget request pertaining to its functions; and Whereas the CIP has met and approved a budget in the amount of $1,012.863 for Fiscal Year commencing October 1, 2008, and ending September 30, 2009; and NOW THEREFORE, BE IT RESOLVED BY THE CIVILIAN INVESTIGATIVE PANEL THAT: 1.
