A RESOLUTION OF THE CITY COMMISSION WITH ATTACHMENTS,
AUTHORIZING THE TRANSMITTAL OF A PROPOSED ORDINANCE
SPECIFICALLY DELINEATING THE BOUNDARIES OF A REGIONAL ACTIVITY
CENTER FOR THE HEALTH DISTRICT TO THE STATE OF FLORIDA
DEPARTMENT OF COMMUNITY AFFAIRS, FOR DETERMINATION OF
CONSISTENCY WITH THE CRITERIA OF RULE 28-24.014 OF THE FLORIDA
ADMINISTRATIVE CODE, AND PURSUANT TO CHAPTER 93.206 OF THE LAWS
OF FLORIDA.
WHEREAS, the Miami Planning Advisory Board, at its meeting of September 17, 2008, Item
No.P.7 following an advertised hearing, adopted Resolution No. PAB --- by a vote of ---- to ---- ( - ),
recommending of authorizing the transmittal of a proposed ordinance specifically
delineating the boundaries of a Regional activity Center as hereinafter set forth; and
WHEREAS, Section 163.3167, Florida Statutes, requires that each municipality in the State of
Florida prepare, adopt and implement a Comprehensive Plan in order to plan for their future growth
and development; and
WHEREAS the City Commission finds it necessary to establish a Health District Regional
Activity Center to attract hospitals, emergency rooms, clinics, laboratories, medical, research and
clinical; including biotechnical laboratories and research facilities, and all other accessory uses in
support of and expansion of medical services, educational facilities, office, commercial, and residential
development in areas of concentrated intensity located in close proximity to major public transportation
facilities and transportation corridors; and
WHEREAS, the City of Miami has determined that the area generally located South of NW
20th Street, North of State Road 836 and north of the Miami River; East of NW 17th Avenue, and
West of Interstate 95, known as the Health District, is a compact, high intensity, high density multi -use
area that is appropriate for intensive growth, and which may be used for: retail; office; cultural,
recreational and entertainment facilities; hotels and motels; major institutional and public facilities and
appropriate industrial activities, and is therefore appropriate for designation as a Regional Activity
Center; and
WHEREAS, the Health District is a major employment area within the City of Miami and
Southeast Florida, employing more than 30,000 people and home to several of the nation's premier
medical, educational, judicial and social services facilities including: The University of Miami Leonard
M. Miller School of Medicine; University of Miami Hospital; Jackson Memorial Hospital; The Miami VA
Healthcare System; Miami -Dade College Medical Campus; Lindsey Hopkins Technical Education
Center; The 11th Judicial Circuit Court of Florida; Office of the State Attorney; Office of the Public
Defender; Miami -Dade County Corrections and Rehabilitation Department; Children's Home Society of
Florida; Miami -Dade County Health Department; Kristi House; and Camillus House. These major
medical and education institutions and facilities within the Health District are expected to continue to

expand and redevelop in order to meet the demands of the region's growing population.
Redevelopment and infill within the District are expected to include residential, retail, office and related
services. Many of these uses are intended to serve the residents and employees in the immediate
area, but all will lead to increased housing and employment opportunities for the region. The
redevelopment will also contribute to the City's continued desire for compact urban development for
residents to live and work in close proximity; and
WHEREAS, the proposed Regional Activity Center is consistent with the comprehensive plan
and future land use map intensities; provides service to, and is regularly used by, a significant number
of citizens of more than one county; contains adequate existing public facilities as defined in Chapter
9J-5, F.A.C., or committed public facilities, as identified in the capital improvements element of the
local government comprehensive plan; and is proximate and accessible to interstate or major arterial
roadways; and
WHEREAS, the creation of a Health District Regional Activity Center is necessary to achieve
the City's goals for continued development and redevelopment of its principal health care, hospital and
research area; and
WHEREAS, the City Commission finds that the area currently referred to as the Health District
is the appropriate urban area to designate as a Health District Regional Activity Center; and
WHEREAS, the City Commission after careful consideration of this matter deems it available
and in the best interest of the general welfare of the City of Miami and its inhabitants to transmit the
attached proposed ordinance to the Department of Community Affairs requesting a determination of
consistency with the criteria of 28-24.014 F.A.C. and pursuant to Chapter 93-206, Laws of Florida;
NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City manager or his designee is hereby authorized to transmit the attached
proposed ordinance to the Department of Community Affairs requesting a determination of
consistency with the criteria of 28-24.014, F.A.C. and pursuant to Chapter 93-206, Laws of Florida.
Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance
is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Resolution shall become effective immediately after adoption thereof {1}.

{1} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within
ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.
