A RESOLUTION OF THE MIAMI CITY COMMISSION. WITH ATTACHMENT(S'. APPROVING A SPECIAL EXCEPTION REQUIRING CITY COMMISSION APPROVAL, AS LISTED IN ORDINANCE NO. 11000, AS AMENDED. THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401. UNDER CONDITIONAL PRINCIPAL USES OF PR PARKS, RECREATION AND OPEN SPACE, TO ALLOW THE CONSTRUCTION OF A RECREATIONAL BUILDING STRUCTURE AND SAID SITE AMENITIES, WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED SUBJECT TO CONDITIONS, FOR THE PROPERTY LOCATED AT APPROXIMATELY 7025 WEST FLAGLER STREET, MIAMI, FLORIDA. WHEREAS, the Miami Zoning Board, at its meeting on July 14, 2008, item No. Z.2, following an advertised public hearing, adopted Resolution Noe ZB 08-058 by a vote of eight to zero (8-0), recommending APPROVAL of a Special Exception requiring City Commission approval as set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter finds the application for the Special Exception meets the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Special Exception requiring City Commission approval, as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, under Conditional Uses of PR Parks, Recreation and Open Space, to allow the construction of a recreational building structure and said site amenities, with a time limitation of twelve (12) months in which a building permit must be obtained, for the property located at approximately 7025 West Flagler Street, Miami. Florida, legally described in "Exhibit A," attached and incorporated, is approved. Section 3. The Internal Design Review Committee on June 10, 2008 made comments regarding the urban design and landscaping which are to be incorporated as the following conditions; a. Enhance the landscape buffers along site perimeters by providing layers of plantings including trees, bairns, shrubs and ground cover. Section 4. The findings of fact set forth below are made with respect to the subject property: a.
