THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 4, SECTION 401, UNDER CONDITIONAL PRINCIPAL USES IN PR PARKS, RECREATION AND OPEN SPACE DISTRICT, TO ALLOW THE CONSTRUCTION OF A DOCK MASTER OFFICE BUILDING FOR THE MARINA ADMINISTRATION, WITH A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED SUBJECT TO CONDITIONS, FOR THE PROPERTY LOCATED AT APPROXIMATELY 1275 NORTHEAST 79TH STREET, MIAMI; FLORI DA. WHEREAS. the Miami Zoning Board, at its meeting on July 14, 2008, Item No. Z.3, following an advertised public hearing, adopted Resolution No. ZB 08-059 by a vote of seven to one (7-1), recommending APPROVAL with a condition that the plans of the existing and proposed facades, signs specifications and paint color samples shall be submitted for the review and approval of the Planning Department prior to the issuance of any building permits, as set forth; and WHEREAS, the Miami Waterfront Advisory Board, at its meeting on September 15, 2008, following an advertised public hearing, adopted Resolution No. WAB-2008-11 by a vote of six to zero (6-0), recommending APPROVAL; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter finds the application for the Special Exception meets the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY TH•E COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2, The Special Exception requiring City Commission approval, as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 4, Section 401, under Conditional Principal Uses in PR Parks, Recreation and Open Space District, to allow the construction of a dock master office building for the manna administration, with a time limitation of twelve (12) months in which a building permit must be obtained for the property located at approximately 1275 City of Miami Page 1 of 6 Printed On: 9/16/2008 lie r' rnber O& OO700xC Northeast 79th Street, Miami, Florida, is approved, subject to the condition that the pan of -the existing and proposed facades, signs specifications and paint color samples shall be submitted for the review and approval of the Planning Department prior to the issuance of any building permits. Section 3. The findings of fact set forth below are made with respect to the subject property: a. Pursuant to Section 1305.2 of the Zoning Ordinance, the specific site plan aspects of the project that have been found by the City Commission (based upon facts and reports prepared or submitted by staff or others) to adhere to the following Design Review Criteria subject to the any applicable conditions herein: I) Site and Urban Planning: Design Review Criteria Applicability Compliance (1) Respond to the physical Yes. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1 } APPROVED AS TO FORM AND CORRECTNESS: JUIJE O. BRU CITY ATTORNE Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
