Dear 4Mtir. de l ioia:
As you are aware; this law firm represents Canyon Capital .Realty Advisors ("Canyon"), owner of
the above -referenced property. You have previously met with Michael Downes, Vice President at
Canyon, regarding the East Coast Fisheries Building as well as the adjacent buildings on the site, which
Mr. Downes agreed to demolish.
You have made Canyon aware of the City's desire to immediately demolish the East Coast
Fisheries Building, and we discovered last week that this matter will be brought before the Historic
Environmental and Preservation Board for a Certificate of Appropriateness for Demolition on July 1,
2008. We were surprised that this has proceeded at such a rapid pace given Canyons history of
cooperation with the City.
Nevertheless, we understand the City's concerns and support the demolition based on information
we received from the City regarding potential future development on the site. Specifically, we understand
that the City would support setback variances on the site based on the site's narrow size, the Miami River
on one side, and a right-of-way on the other, as these conditions constitute a legal hardship, which
justifies the granting of setback variances for this property. Based on the foregoing, Canyon does not
object to the demolition of the building.
