A RESOLUTION OF THE MIAMI CITY COMMISSION OPPOSING "AMENDMENT 2,"
FLORIDA'S MARRIAGE PROTECTION AMENDMENT," A CONSTITUTIONAL
AMENDMENT BANNING SAME -SEX MARRIAGE, CIVIL UNIONS, AND DOMESTIC
PARTNER BENEFITS; WHICH WILL BE CONSIDERED BY FLORIDA VOTERS ON
THE NOVEMBER 4, 2008 ELECTIONS BALLOT.
WHEREAS, the City of Miami ("City") is a diverse community which prides itself on having
enacted one of the first Human Rights ordinances in the State of Florida, which intent is to secure for
all individuals within the City freedom from discrimination in housing, employment, and public
accommodations on account of race, color, national origin, religion, sexual orientation, age, handicap,
marital status or familial status; and
WHEREAS, on November 4, 2008, Florida voters will be asked to vote on a proposed
amendment to Florida's Constitution, known as "Amendment 2" or "Florida's Marriage Protection
Amendment," which is a proposed constitutional amendment to ban same -sex marriage in Florida civil
unions and possibly domestic partner benefits; and
WHEREAS, Florida already has multiple laws banning same -sex marriage; but if Amendment
2 passes, the impact of writing such a prohibition into the State Constitution could seriously impact
the rights of many Floridians; and
WHEREAS, as an example, the passage of Amendment 2 may prohibit, and/or otherwise
declare illegal, companies in the private and public sectors from maintaining domestic partner
registries, and offering benefits (such as health insurance) to employees with domestic partners,
whether these domestic partnerships are same -sex partnerships or not;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted
by reference and incorporated as if fully set forth in this Resolution.
Section 2. The Miami City Commission opposes "Amendment 2," "Florida's Marriage
Protection Amendment," a constitutional amendment banning same -sex marriage, civil unions, and
domestic partner benefits, which will be considered by Florida voters on November 4, 2008 elections
ballot.
Section 3. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.{1}

{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
