Between the City of Miami, Florida and the Fraternal Order of Police,
Walter E. Headley, Jr., Miami Lodge 20
Pertaining to Certain Provisions of the
Collective Bargaining Agreement (2007-2010)
This Memorandum of Understanding is entered into this day of
, 2008 between the City of Miami, Florida ("City") and the Fraternal
Order of Police, Miami Lodge 20 ("FOP") (jointly "the parties") to amend the 2007-2010
collective bargaining agreement as follows:
I. ARTICLE 18.4 - PAY STRUCTURE EFFECTIVE DATE
WHEREAS, Article 18 (Wages), specifically section 18.4, in part, states: "A new
.pay structure will be implemented the first full pay period following ratification of the
labor agreement by the parties, providing for two and one-half percent (2.5%) increases
every six (6) months for steps 2 through 16..."
WHEREAS, section 18.6, in part, states: "Upon the enactment of section 18.4 of
this agreement, bargaining unit members will become eligible for two (2) new two and
one-half percent (2.5%) increases at steps 17 and 18..."
NOWTHEREFORE, the parties agree that the new pay structure was
implemented the first full pay period following October 1, 2007, as intended through the
negotiations; thus, not following ratification which occurred in April 2007.
II. ARTICLE 18.19 — DEGREE BONUS
WHEREAS, Article 18(Wages), specifically section 18.19 states:
Bargaining unit members who successfully obtain a college or
university degree from an accredited university in the United
States, with a field of study related to their job duties, will receive
the following annual bonus (prorated and paid on a bi-weekly
basis) upon successful completion of probation, regardless when
his/her probation is completed:
a. Associate in Arts Degree- $1,200
b. Bachelorate Degree- $2,200
c. Masters Degree- $3,200
d. Juris Doctor, Ph.D, or Ed.D.- $4,200
It is the responsibility of the bargaining unit member to request for
the degree bonus by submitting a red line memorandum to the
Director of Employee Relations, through channels, accompanied
by a certified true original of the college or university transcripts.
The degree bonus shall not be included in pension calculations of
earnings.

NOWTHEREFORE, the parties agree that the bargaining unit members shall
also receive an annual pro -rated bonus in the amount of $1,200.00 for Associates in
Science degree obtained from an accredited university in the United States. The annual
bonus shall only be granted upon successful completion of probation, regardless when the
probation is completed. All other procedures set forth in section 18.19 are applicable.
The parties agree that bargaining unit members who previously submitted applications
for an Associates in Science degree and whose degree is from an accredited university in
the United States will receive the retro-active, pro -rated degree bonus effective following
the first full pay period after ratification of the collective -bargaining -agreement (2007-
2010).
NOWTHEREFORE, the parties also agree that the field of study. does not have
to relate to their job duties in order to receive the annual degree bonus. This amendment
to the field of study shall become effective following the first full pay period following
ratification of this memorandum of understanding.
NOWTHEREFORE, the parties agree that bargaining unit members shall only
receive an annual degree bonus for the single highest educational degree.
III. ARTICLE 34- SUBSTANCE/ALCOHOL — PERSONNEL
SCREENING
WHEREAS, in accordance with Article 34 the parties agreed to use "Industry
Standards" to determine a positive test result for the drugs "Ketamine,""Gamma-
hydroxybutyrate," and "Methylenedioxymethampetamine" ("MDMA, Ecstasy").
WHEREAS, to date, no "Industry Standards" are established for Ketamine and
Gamma-hydroxybutyrate.
NOWTHEREFORE, the parties agree that whenever Federal and State "Industry
Standards" are established governing testing for Ketamine and Gamma-hydroxybutyrate,
the parties will comply with those established standards. However, until such time as
Industry Standards are established, the parties agree that a positive test result for the
drugs Ketamine and Gamma-hydroxybutyrate are as follows:

• FURTHER, the parties agree that the drugs Ketamine and Gamma-
hydroxybutyrate will be tested under reasonable belief in accordance with Article 34.1
and will not be included as part of the random substance screenings in accordance with
Article 34.2.
FURTHER, an Industry Standard was established for
Methylenedioxymethampetamine ("MDMA, Ecstasy"); thus, the parties agree that a
positive test result for MDMA, Ecstasy shall be a concentration in the excess of the

IV. ARTICLE 35 — HEART BILL/PHYSICALS
WHEREAS, the parties agree that the re -certification physical requirements for
bargaining unit members in the Bomb Squad unit will be incorporated into Article 35 of
the collective bargaining agreement.
NOWTHEREFORE, Article 35 is amended as follows:
Section 35.3 — The parties agree that the bargaining unit members in the Bomb Squad
unit shall successfully pass a yearly physical fitness test in order for the bargaining unit
members to become certified or maintain the certification as a bomb technician. The re-
certification requirements will be in accordance with the Federal Bureau Investigation's
29 Code of Federal Regulations (CFR), section 1910.120(q)(6)(iii), Emergency Response
to Hazardous Substances Releases, Hazardous Materials Technician.

V. ARTICLE 45 — TERM OF AGREEMENT
WHEREAS, Section 45.4 of the 2007-2010 collective bargaining agreement
Initial discussions shall thereafter, and no later than June 1, 2005, be
entered into by the City and the F.O.P.
NOWTHEREFORE, the parties agree to amend Section 45.4 as provided herein
to accurately reflect that the City and the F.O.P. shall enter into the initial discussions at a
