Aluko ' 4 REFERENCES: ITB 07-08-015 Director Department of Capital Improvements ENCLOSURES: Background The Department of Capital Improvements Program (CIP) received seventeen (17) bids on April 18, 2008, in response to the solicitation for the Replacement of Fire Station No. 11, which are reflected on the attached Bid Submittals List One of the bids was received after the submission sleadlineand-wasnot-considered for award: - The scope of work for this project indudes the demolition of the existing fire station and the construction of a new 11,749 square foot fire station to be located at 5920 West Flagler Street. The Project also includes water main improvements and new street signalization on Flagler Street. Bidders were required to possess a minimum of five (5) years experience in the construction of similar projects, including five (5) separate projects of a similar, size, scope, and complexity, within the past five (5) years. Findings CIP's initial review of the bidders to ensure responsiveness to the minimum requirements of the bid has -resulted in the determination that the two lowest bidders TC&F Builders, Corp. and American Building, Engineers are non -responsive based on the following: ➢ TC&F Builders, Corp. (TC&F) was incorporated in December 2004 and does not meet the minimum of five years experience. In addition TC&F only identified two projects they state were of a similar size, scope and complexity. TC&F did identify four other projects that were completed by the company TJ Builders, Corp. The owner of TC&F stated that TJ Builders, Corp. was a separate company that he was a part owner and that the company is no longer active. A American Building Engineers did not utilize the City's bid forms, did not include all of the required documentation, and they inducted additional contractual language in their proposal. Based on the fact that both bidders have been determined to be non -responsive, CIP has not evaluated either company to determine if they are responsible. The third low bidder, NAC Construction, Inc., bid is responsive and CIP has completed a review of the company to determine if they are a responsible bidder. This review included talking to the MDCPS and Miami -Dade County to ascertain the quality and timeliness of their work on the projects NAC completed for both entities. Both entities provided very positive evaluations of for NAC. In addition, a meeting was held on June 4, 2008 to review their bid price to ensure that it included all components of the work as NAC's bid is 20.4% below the construction estimate. Based on the meeting it was determined that MAC did include all of the cost components in their bid price. Recommendation Based on the above we are recommending that the award be made to the lowest responsive and responsible bidder, NAC Construction, Inc.
