HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 08-00733 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A UNITY OF TITLE, IN SUBSTANTIALLY THE ATTACHED FORM, RESTRICTING THE USE OF TWO CITY -OWNED PARCELS OF LAND, LOCATED AT ROBERT KING HIGH PARK, 7025 WEST FLAGLER STREET, MIAMI, FLORIDA, AS DESCRIBED IN "COMPOSITE EXHIBIT A," ATTACHED AND INCORPORATED, WITH TERMS AND CONDITIONS AS MORE PARTICULARLY SET FORTH IN SAID UNITY OF TITLE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") has established two capital improvement projects to design and construct a new 5,768 square foot community building with site improvements and to design and construct a new soccer field with new adjacent restrooms; and WHEREAS, said projects have been incorporated into the City's Capital Improvement Program ("CIP") and Multi -year Plan as Project No. B-35868, entitled "Robert King High Park New Building and Site Improvements," and Project No. B-30229, entitled "Robert King High Park Soccer Field," ("Projects"); and WHEREAS, the City conducted a competitive selection process, and issued a Request For Qualifications No. 02-03-163, for Miscellaneous Professional Services for Architectural Professional Services, dated May 23, 2003, in accordance with Florida Statutes' Section 287.055 Consultants' Competitive Negotiation Act, as amended, and the applicable provisions of the City's Procurement Department, to secure qualified outside consultants for design services of various CIP vertical projects; and WHEREAS, Post, Buckley, Schuh and Jernigan, Inc., ("PBS&J") was selected as one of several consultants to provide miscellaneous professional. architectural, landscape architectural, surveying/mapping or engineering services as directed by the CIP Director for such projects and/or tasks as may be required; and WHEREAS, PBS&J, Inc., was assigned to design the Projects which include: Robert King High Park New Building and Site Improvements (a new 5,768 square foot community building, new covered and uncovered basketball courts, new tennis court, upgrade of existing tennis and basketball courts and existing sports lighting, a new perimeter fence, new walkways, sand volleyball court, parking lot, playground and picnic areas, landscaping and irrigation) and Robert King High Park Soccer Field (design of new soccer field approximately 120 yards x 65 yards, new sports lighting and irrigation systems, bleachers, new restrooms, handicapped parking lot and landscaping); and WHEREAS, the design phase for these Projects has been completed and both Projects will be advertised for competitive bids to select a contractor and begin construction; and File Number. 08-00733 WHEREAS, the Miami -Dade Water and Sewer Department has requested the unity of title for these projects in order to complete the final phase of the permitting process; and WHEREAS, the City is the owner of two parcels of certain real property located at 7025 West Flagler Street, Miami, Florida, and desires to unite these parcels in order to obtain construction permits for both Projects as these two parcels share underground utilities and share an accessibility through a mutually connected road; and WHEREAS, pursuant to Section 910 of Zoning Ordinance 11000, in order to obtain the necessary approvals from the Planning Department, Zoning Department and the Building Department ("Departments") and other permitting agencies to connect these parcels as one site, the execution of a Unity of Title is required and shall be filed as a permanent part of public property records in the Miami -Dade County; and WHEREAS, execution of the attached Unity of Title will satisfy the Departments' requirements by placing limitations on the land encompassing the building site; and WHEREAS, the Unity of Title shall remain in full force and effect until such time as the same may be released in writing by the Zoning Administrator; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute a Unity of Title, in substantially the attached form, restricting the use of two City -owned parcels of land, located at Robert King High Park, 7025 West Flagler Street, Miami, Florida, as described in "Composite Exhibit A," attached and incorporated, with terms and conditions as more particularly set forth in said Unity of Title. Section 3. The City Manager is further authorized{1} to execute all necessary documents for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESSe, JULIE O. BRU CITY ATTORNEY �, File Number: 08-00733 Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including, but not limited, to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
