Lista, Inc. for the structural repair of City Hall. Purpose of Item: To request approval of the attached resolution, by a four -fifths affirmative vote, adopting the City Manager's finding of an emergency, waiving competitive sealed bidding procedures of City Code Section 18-85, authorizing the City Manager to accept the bid and execute an agreement with the Walter L. Lista, Inc for the structural repair of City Hall for an amount not -to -exceed $418,000. Background Information: Pursuant to a work order issued December 6, 2007, a structural analysis performed by Bliss & Nyitray, Inc. on the City Hall Basement, uncovered existing conditions that presented a life safety issue. In order to expedite the critical repairs, a competitive process was utilized where five companies were invited to submit sealed bids within thirteen (13) days of notification. Pursuant to a motion approved by the City Commission July 24, 2008, based on the City Manager's Recommendation, dated July 22, 2008 and attached hereto, authorization for the lowest bidder, Walter L. Lista, to commence work was given upon the condition that Commission approval of the award and waiver of competitive bidding procedures would be sought in this Commission meeting. CIP determined Walter L. Lista, Inc. to be the lowest responsive and responsible bidder, at a bid price of $298,000 for the scope of work, which includes repair of the structural columns, removing old steel and encasing columns in concrete. CIP also requires an owner contingency to cover unforeseen work, such as relocation of electrical and plumbing utilities or conduits, of $120,000. This resolution therefore seeks award and contract execution authority to Walter L. Lista, Inc., for a total not -to - exceed contract amount of $418,000.
